Caelum IV: 18 property owners summoned for the payment of fair price compensation
Por FactBox Admin

The Official Gazette of the Province of León publishes this Tuesday, October 27, 2026, the resolution of the Government Delegation in Castilla y León calling for the drawing up of payment records for the properties affected by the Caelum IV photovoltaic installation, in the municipal districts of Gusendos de los Oteros, Corbillos de los Oteros, Santas Martas, and Pajares de los Oteros. Those summoned must appear on November 24, 2026, at the headquarters of the city council corresponding to each property to collect the fair price established by the Provincial Expropriation Jury. The announcement is identified with the reference BOP-LE-2026-204029.
The origin: public utility declared in 2024
The basis of the file is the resolution of July 24, 2024, from the General Directorate of Energy Policy and Mines of the Ministry for the Ecological Transition and the Demographic Challenge, published in BOE number 197 of August 15, 2024, which granted Caelum Renovables, S.L. the administrative authorization, the approval of the execution project, and the recognition of the project’s public utility.
That declaration of public utility, supported by article 56.1 of Law 24/2013, of December 26, on the Electricity Sector, implies the necessity of occupying the affected assets and rights and entails urgent occupation for the purposes of article 52 of the Forced Expropriation Law, of December 16, 1954.
- Peak power: 119.20 MW.
- Installed power: 106.43 MW.
- Object: the plant and its evacuation infrastructures.
A fair price without agreement and now final
As stated in the resolution itself, the drawing up of previous records—and, where applicable, occupation records—took place on March 4 and 5, 2025, when the assets and rights subject to expropriation were identified and described. Since no agreement was reached through administrative channels regarding the fair price, the file was referred to the Provincial Expropriation Jury, which set it definitively through a resolution that has already become final in administrative proceedings.
Now, in accordance with articles 48 and 52 of the Forced Expropriation Law, the payment of the fair price and, where applicable, the legally applicable interest, is due. The act will be held at the headquarters of the city council of the affected municipal district, and interested parties must attend personally or be duly represented, with an identity document and, if applicable, documentation proving ownership of the bank account, as payment will be made by transfer.
Calendar for November 24
The annex to the resolution, titled “Concrete and individualized list of ordered payments,” details 18 summons, ordered by time, with the cadastral reference of each property:

The resolution was electronically signed on October 14, 2026, by the Government Sub-delegate in León, Héctor Alaiz Moretón, by virtue of the delegation approved by the resolution of April 22, 2021 (BOE number 113, of May 12, 2021). The order for the drawing up of the records will appear on the notice boards of the four town halls and will be communicated to each interested party by summons; publication in the BOP also serves as notification, pursuant to Article 44 of Law 39/2015, in cases of unknown owner, unknown address, or failed notification attempt.
The procedure affects a project of nearly 120 MW in the southeast of the province and closes, at least through administrative channels, an expropriation conflict open since the occupation of the estates in March 2025. For the cited owners, the appointment on November 24 is the final stop to collect the fair price—or, if they deem it necessary, to challenge it before the contentious-administrative jurisdiction—while the two payments to Orsted Onshore Spain IV confirm the presence of an international energy operator among the beneficiaries of the expropriation.
