Burgos appoints Isabel Galindo as traffic sanction instructor.

The Provincial Council of Burgos has appointed Isabel Galindo Mateo, head of the Tax Management and Collection Service, as instructor of the sanctioning procedures for infringement of traffic rules, motor vehicle circulation and road safety of the municipalities that delegate that competence. The decree, signed on August 5, 2026, is published in Official Bulletin of the Province of Burgos number 152, of August 13, 2026, with reference BOPBUR-2026-03485.

The provincial institution has assumed, by delegation of powers, the processing of traffic sanctioning procedures of several municipalities in the province. The delegation of the sanctioning power is based on article 25 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector, and is expressly recognized in article 84.2 of Royal Legislative Decree 6/2015, of October 30, consolidated text of the Law on Traffic, Motor Vehicle Circulation and Road Safety.

The role of the instructor

Article 63 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, requires that sanctioning procedures separate the investigative phase from the sanctioning phase and entrust them to different bodies. Based on the powers assumed, the Provincial Council considers it necessary to designate an investigating body for these procedures.

The position falls to Isabel Galindo Mateo, a civil servant who satisfies the legal reservation of public functions required by article 9.2 of Royal Legislative Decree 5/2015, of October 30, approving the consolidated text of the Law on the Basic Statute of Public Employees (TREBEP). The agreement orders that the interested party be notified of the appointment.

Legal framework of the delegation

The delegated processing of traffic sanctions is based on a threefold legal basis:

• Article 25 of Law 40/2015, which allows public administrations to delegate the exercise of the sanctioning power.
• Article 84.2 of Royal Legislative Decree 6/2015, which authorizes the delegation of sanctioning powers in traffic matters through agreements, management assignments or other collaboration instruments provided for in the legislation on common administrative procedure.
• Article 63 of Law 39/2015, which imposes the separation between the investigative phase and the sanctioning phase, and article 9.2 of the TREBEP, which reserves to civil servants participation in the exercise of public powers.

Guarantees of the procedure

The decree incorporates the guarantees of impartiality of the instructing body. If any of the grounds for abstention provided for in article 23 of Law 40/2015 should concur, the instructing officer must bring it to the attention of her hierarchical superior; in addition, interested parties may seek her recusal at any time during the procedure, in accordance with article 24 of the same law.

The resolution, adopted by the Presidency, is signed by the delegated deputy Jorge Castro Urbiola by virtue of the delegation of signature conferred by the president through decree 2023010710, of October 24, 2023, and is countersigned by the secretary José Luis M.ª González de Miguel. The agreement also provides for publication in the official bulletin, for the purposes of article 45 of Law 39/2015.

With this appointment, the Provincial Council completes the administrative machinery to process the traffic penalties of the municipalities that delegate the competence, which affects drivers throughout the province: it will be the provincial services, and not each town council, that process the files for traffic offenses. Publication in the BOP gives publicity to the designation and allows citizens to know the body responsible for processing their files.
