Breda definitively approves the tax ordinances and the one regarding animal ownership
Por FactBox Admin

The Plenary of the Breda City Council has made definitive, without any claims, the agreement to modify several municipal tax ordinances and Tax Ordinance No. 11 on the protection, control, and ownership of animals. The full text of the modifications is published in the Official Gazette of the Province of Girona no. 199, dated October 15, 2026, with the official reference CVE BOP-2026_0_199_8825 and the signature of the mayor Dídac Manresa Molins on October 9, 2026.
The agreement was initially adopted in the ordinary session of the Plenary on August 3, 2026 and, once the public exhibition period ended without claims or suggestions, it became definitive through the application of article 17.3 of the Recast Text of the Law regulating local finances (Royal Legislative Decree 2/2004, of March 5) and article 49 of Law 7/1985, of April 2. The modification of the animal ordinance is processed under file no. X2024002220.
The ordinances do not enter into force until publication in the BOP has occurred and, as a general rule, apply from that moment, unless they establish a later date. The animal ordinance enters into force fifteen days after its publication.
New taxes for occupying the local public domain
Tax Ordinance No. 7, on taxes for the private use and special exploitation of the local public domain, sets the following rates:
- Occupation of the public road with goods, construction materials, or rubble: €0.50/m², with a minimum of €15 per month.
- Cranes used in construction: €21.00/m².
- Tables and chairs: €19.00/m² annually or €8.00/m² per quarter; market stalls and dismantleable structures: €32.00/m² annually or €14.00/m² per quarter.
- Kiosks for the sale of press, books, plants, and flowers: €32.00/m² per quarter.
- Vehicle entrances through sidewalks: between €8.85 and €16.35 per linear meter per year; curb ramp plate, €18.00.
- Street cuts: €35.00/day in the central network and €25.00/day in the periphery.
- Parking spaces for people with disabilities: €20.00 per linear meter per year, plus €100.00 for signage.
Merchants registered in Breda for the economic activities tax and entities registered in the Municipal Registry of Entities and Citizen Associations (RMEAC) are exempt from the market stall tax. The regulation also governs the curb ramp with special regulation (GARE).
Sanctioning regime for animal ownership
Tax Ordinance No. 11 updates the infractions in articles 62 to 65 and incorporates an annex with the complete table of infractions and sanctions. The amounts are:
- Minor infractions: €300 in general, with amounts between €100 and €500 depending on the case.
- Serious infractions: €3,001, with amounts of €751, €10,001 or €300.52 depending on the case.
- Very serious infractions: €9,001, reaching €50,001 or €2,404.06 in the most serious cases.
Sanctions may include fines, seizure of the animals subject to the infraction, total or partial temporary closure of the facilities, and community service. The commission of very serious infractions or the repetition of serious ones may lead to disqualification from owning animals for a period between two months and five years.
Municipal census and deadlines for owners
The transitional provision requires owners or possessors of pets and potentially dangerous animals that are not registered in the municipal census or do not have a specific license to formalize the registration and process the permit within a period of three months from the date of entry into force. The municipal census includes a specific section for dogs considered potentially dangerous.
Regarding administrative deadlines, very serious infractions prescribe after 3 years, serious ones after 2 years, and minor ones after 6 months, while the sanctioning procedure expires if no express resolution is issued within 6 months.
The publication closes the approval procedure and opens the way for contentious-administrative appeals for eligible persons. The impact is direct for all residents of Breda: any resident who occupies the public road, has a driveway, or a pet is subject to the new fees and the updated sanctioning regime.
