Borriol definitively approves the urban planning regularization of Alcormar

The Borriol City Council has taken a decisive step towards the urban planning regularization of the Alcormar urbanization. The Municipal Plenary, in an extraordinary session held on July 30, 2026, definitively approved the ordinary works project necessary to provide the area with the urban services required by current regulations. The agreement was published this Tuesday, August 18, 2026, in the Official Gazette of the Province of Castellón, number 99, under the administrative reference 167444.

The initiative responds to the need to adapt the urbanization to Article 190 of the Consolidated Text of the Urban Planning and Environmental Protection Law (TRLOTUP), which establishes the obligation to provide residential areas with basic infrastructure services. The file, registered under number 1682/2025, includes a set of technical documents ranging from the explanatory report to the detailed account of the fees that will fall on the affected property owners.

Documents definitively approved

The plenary agreement contemplates the joint approval of four fundamental instruments for carrying out the works:

  • Ordinary works project for the urban planning regularization of the homes in the Alcormar Urbanization in Borriol.
  • Explanatory report that substantiates the intervention and its scope.
  • Detailed and justified account of the urbanization fees, which determines the economic contribution of each property owner to the cost of the actions.
  • Definitive urban planning agreement, incorporating the observations made during the public information procedure.

Urban planning agreement: observations partially accepted

During the public information period, interested parties submitted six observations on the draft agreement. The Plenary accepted observations 1st, 2nd, 3rd, 4th, and 6th, incorporating them into the final text with the aim of improving the wording, legal scope, and guarantees for those affected. However, it rejected observation 5th, which proposed including the possibility of partial acceptances of the works in accordance with Article 111.3 of Law 9/2017, on Public Sector Contracts.

The reason for the rejection, according to the agreement, is that the scope of the agreement must be treated as a functional unit that must be fully provided with basic urban services, with partial acceptance being incompatible with the objective pursued by Article 190 of the TRLOTUP. The definitive approval is made on the basis of the report issued by the Municipal Architect on June 18, 2026, which dismissed the allegations submitted against the project.

Implications for property owners

The agreement has direct effects on the residents of the Alcormar Urbanization, who must assume the urbanization fees resulting from the detailed account approved. The Plenary authorized the Mayor’s Office to sign the agreement and carry out all acts necessary for its effectiveness. Likewise, it was ordered to notify the agreement to all owners and holders of rights over the land affected by the intervention.

The final approval also provides for the registration of the agreement and the supporting report in the Property Registry once it is final in administrative proceedings, in accordance with Article 98.5 of the TRLOTUP and Article 1 of Royal Decree 1093/1997 on the registration of acts of an urban planning nature. The agreement must be sent to the competent Regional Ministry for Urban Planning of the Valencian Government.

Available appeals

Those affected have one month to file a potestative appeal for reconsideration before the City Council itself, or two months to go directly to the Court of First Instance in the contentious-administrative jurisdiction. The Plenary’s resolution exhausts the administrative route, in accordance with Articles 123 and 124 of Law 39/2015 and Articles 8, 45 and 46 of Law 29/1998, of 13 July.

The decision represents a significant milestone for the Alcormar urbanization, a consolidated residential area in Borriol that until now lacked the urban services infrastructure required by legislation. The approval of the project paves the way for the execution of the works, whose cost will be borne by the owners through the urbanization fees that have been calculated in detail in the file.
