Bienservida approves fee for events in municipal buildings

The Bienservida City Council has definitively approved the Fiscal Ordinance regulating the tax for the private use or special exploitation of municipal buildings and facilities for celebrations and private events, which taxes the use of public spaces such as the swimming pool, the mountain refuge, or the library for private festivities. The regulation, agreed upon by the Plenary session on June 24, 2026, is published in the Official Gazette of the Province of Albacete number 107, dated September 14, 2026, in the third Section of Local Administration (pages 18 to 20).
The ordinance was processed following the publication of the announcement in BOP number 82, dated July 17, 2026, and, as the legal period elapsed without any claims being filed, it is now firmly approved. The text is based on articles 133.2 and 142 of the Spanish Constitution, article 106 of Law 7/1985, of April 2, regulating the Bases of the Local Regime, and articles 15 to 19 and 57 of Royal Legislative Decree 2/2004, which approves the revised text of the Law regulating Local Treasuries.
Rates per facility
The tax quota is set as a flat fee per day of occupancy or fraction thereof, depending on the facility and the authorized use:
- Municipal Pool Bar: €100.00 per day for private celebrations, subject to availability according to the summer concession contract.
- Municipal Mountain Refuge: €50.00 per day for private celebrations, coexistence days, or daytime recreational events.
- Municipal Library: from €100 to €300 per day for private use in workshops or cultural events.
Payment is made via prior self-assessment before the Municipal Treasury, and the City Council will not process any request or space reservation until the payment is justified. The tax accrues at the moment the application is submitted to the General Registry.
Deposit and rules of use
Along with the payment of the tax, the applicant must deposit a security deposit equivalent to 100% of the fee amount, which is returned after the municipal technical inspection once the event has ended and the good condition of the facilities has been verified. If damage or lack of cleanliness is detected, the City Council may seize the deposit in full or in part, without prejudice to demanding the actual cost of repairs.
The authorization for use is personal and non-transferable, and the assignment, transfer, or subletting of the space is prohibited. The user must return the premises in the same conditions of cleanliness and order, remove waste, and adhere to the schedule and noise limits of the municipal ordinances. In the Municipal Mountain Refuge, overnight stays are expressly prohibited, and the breach of this rule entails the full loss of the deposit, immediate eviction, and the initiation of the corresponding sanctioning proceedings.
Exemptions for associations and entities
The ordinance provides for the possibility of a 100% fee exemption, at the discretion of the Mayor’s Office-Presidency, for activities of general or local interest:
- Local non-profit associations registered in the Municipal Registry of Associations that organize cultural, charitable, social, sporting, or recreational activities open to the public.
- Neighborhood entities or festival committees for traditional events or popular festivals.
- Public educational centers within the municipal district for pedagogical, training, or extracurricular activities.
- Institutional acts promoted by other public administrations.
In no case will the exemption be granted if the event, even if requested by a non-profit association, is strictly closed, for private enjoyment, or for disguised commercial profit. Tax offenses are sanctioned in accordance with the General Tax Law, and non-tax usage offenses according to Title XI of Law 7/1985.
The ordinance, signed by Mayor José Luis Cano Ledesma on August 31, 2026, enters into force on the day of its full publication in the BOP. With this measure, the municipality regulates for the first time the private use of its public facilities, establishing a clear framework of rates, deposits, and exemptions affecting both residents and local associations that hold events in municipal spaces.
