Benavente approves the regulations for temporary employment pools

The Benavente City Council has approved the new regulation governing the management and operation of temporary employment pools (interim/labor), published in the Official Gazette of the Province of Zamora number 107, dated September 14, 2026. The regulation, signed on September 11, 2026, directly affects all applicants for temporary municipal positions.
The regulation is based on Article 23 of the Spanish Constitution and Royal Legislative Decree 5/2015, of October 30, which approves the revised text of the Basic Statute of Public Employees Law, and complies with the principles of Article 129 of Law 39/2015, of October 1, on the Common Administrative Procedure. Its objective is to combine management agility with the principles of equality, merit, capacity, and publicity.
Types of pools and selection systems
The regulation distinguishes three types of employment pools:
- Pools obtained from a selective process, composed of applicants who, having reached the score set in the rules, did not obtain a position.
- Specifically convened job pools, which rank applicants according to their training, professional experience, and the tests determined in the call for applications.
- Complementary employment pools, which do not repeal those currently in force and whose members are only called once the priority pools have been exhausted.
Pools may be open or closed. The admitted selection systems are competitive examinations (oposición), merit-based competitions (concurso), and combined competition-examinations (concurso-oposición), with preferential and non-preferential lists.
Call-ups and applicant statuses
Call-ups are carried out by the Human Resources Service in order of precedence, via telephone:
- Ordinary: two calls with a minimum interval of two hours and a 24-hour period to accept or reject the offer.
- Urgent: two calls with at least a half-hour interval and acceptance or rejection at that same moment.
Members may be in five statuses: available, working, unreachable, temporary removal, and permanent removal. The unjustified rejection of a call-up maintains the available status but moves the person to the end of the pool; two consecutive rejections within six months or three in any period result in permanent removal.
Evaluation, agreements, and validity
Upon completion of temporary employment, the head of the service may submit a performance evaluation report within 15 calendar days. The Human Resources Service, after hearing from the workers’ representatives, may declare a candidate unfit for future call-ups, with a period of 10 business days for appeals.
The regulation allows for agreements with other public administrations for the reciprocal use of job pools, always under the principle of reciprocity and only when one’s own pools have been exhausted. The lists will be published on the notice board and on the City Council’s electronic office.
The regulation repeals the previous regulation published in the Official Provincial Gazette number 136, of November 9, 2015, and will enter into force once definitively approved by the Plenary, published in the gazette, and after the period set forth in article 65.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime. From that moment, it will be applicable to all job pools and waiting lists currently in effect at the Benavente City Council.
