Barbastro modifies the productivity bonus agreement for its employees

The Extraordinary Plenary Session of the Barbastro City Council, held on August 20, 2026, approved the modification of the agreement regulating the recognition, determination, and allocation of the productivity supplement for municipal public employees. The resolution, signed on August 21 by the Mayor-President Fernando Torres Chavarría, is published in the Official Gazette of the Province of Huesca number 160, dated August 24, 2026, with reference BOPH-2026-160003.
The agreement, which affects the entire City Council staff, both civil servants and contractual employees, specifically modifies Article 7 of the current text. The regulation is framed within Royal Decree 861/1986, of April 25, which regulates the productivity supplement as remuneration for special performance, extraordinary activity, and the interest and initiative of the worker, and within Royal Legislative Decree 5/2015, of October 30, which approves the revised text of the Basic Statute of Public Employees.
Background of the regulation
The Barbastro City Council first approved a regulation to establish the criteria for allocating these supplements in the Plenary Session of January 25, 2022, following a debate in which diverse opinions were expressed. That agreement was subsequently modified by the Plenary Session of September 30, 2025, and now the Extraordinary Plenary Session of August 20, 2026, introduces a new revision focused on Article 7.
The statement of motives emphasizes that the productivity supplement is “particularly controversial,” often due to its improper use when intended to remunerate concepts inherent to the job position, and because of the suspicions it generates regarding the recipients, the amount, or the frequency of payment.
Regulated criteria and amounts
The agreement establishes a catalog of objective criteria for the recognition of the supplement, each with its own remuneration limits:
- Extraordinary activity (art. 3): up to 100% of the monthly basic and complementary remuneration, with a maximum of one payment in two consecutive fiscal years.
- Accumulation of tasks (art. 4): up to 15%, with a maximum of six payments in the same fiscal year and eight in two consecutive years.
- Accumulation of tasks with greater responsibility (art. 5): up to 30%.
- Temporary occupation of another position with greater responsibility (art. 6): the difference between the remuneration of both positions.
- Work on holidays (art. 7): up to €125/day during the major festivals of September.
- Training actions (art. 8): up to €150 per hour or fraction taught.
- Functions not included in the RPT (art. 9): up to 8% or 15% depending on the case.
- Cash shortage/handling (art. 10): up to 8%, in proportion to the days of cash handling.
Procedure and guarantees
The proposal for the supplement must originate from the Head of the competent Service, be signed by the delegated councilor, and be formalized by decree of the Mayor’s Office. The interested party will have 5 business days from the notification to object to the assignment. The agreement excludes accrual during leaves, vacations, and temporary disability, and establishes incompatibilities between criteria and with gratifications for extraordinary services.
Against the resolution, which exhausts the administrative route, a contentious-administrative appeal may be filed before the Contentious-Administrative Court of Huesca within two months, or an optional appeal for reversal within one month.
The review provides greater legal certainty to a remunerative concept sensitive to the municipal staff, setting clear limits and objective criteria that prevent the perpetuation of payments and safeguard the City Council’s budgetary control.
