Barbadás dismisses Daniel Rey as first deputy mayor
Por FactBox Admin

The Mayor’s Office of the Concello de Barbadás has revoked all competencies delegated to councilor Daniel Rey López and agreed to his removal as first deputy mayor, in addition to withdrawing the remuneration he had been granted for that position. The decision, signed by Mayor Xosé Carlos Valcárcel Doval, appears in the Mayor’s Office resolution of September 29, 2026, Decree no. 2026-2042, and is published in the Official Gazette of the Province of Ourense on October 15, 2026. The three effects are retroactive to 2:30 p.m. on September 28, 2026.
The publication is carried out in compliance with Article 44 of Royal Legislative Decree 2568/1986, of November 28, which approves the Regulation on the organization, operation, and legal regime of local entities. The resolution further invokes Article 9.3 of Law 40/2015, of October 1, on the legal regime of the public sector, and Article 23.4 of Law 7/1985, of April 2, regulating the bases of the local regime, as the basis for the Mayor’s Office’s powers to issue the agreement.
The announcement signed in Barbadás on September 28, 2026, bears registration number R. 2.330 and literally collects the operative part of the resolution, which is structured into three pronouncements.
The three agreements of the Mayor’s Office
- Revoke all competencies delegated to councilor Daniel Rey López, effective from 2:30 p.m. on September 28, 2026.
- Remove Daniel Rey López from his position as first deputy mayor of the Concello de Barbadás, with the same effective date and time.
- Withdraw the remuneration recognized for the councilor, corresponding to the position of Deputy Mayor, also effective from 2:30 p.m. on September 28, 2026.
The third point adds that the withdrawal of remuneration occurs “by virtue of the resignation made by him,” meaning that the councilor himself submitted the resignation from the position before the Mayor’s Office formalized the removal. The resolution does not detail the reasons for the resignation nor indicate who will assume the first deputy mayoralty.
A delegation signed four days prior
The removal occurs a few days after the Mayor’s Office of Barbadás had delegated all functions inherent to the Mayor’s Office to the same councilor. By resolution of September 24, 2026, Decree no. 2026-1687, and under Article 47.2 in relation to Articles 43 and 44 of the local regime regulation, those functions were delegated to Daniel Rey López as first deputy mayor during the absence of the Mayor, between October 9 and 12, 2026, both inclusive.
That delegation was published in the Official Gazette of the Province of Ourense on October 8, 2026, that is, after the cessation had already taken effect. The chronological coincidence between both announcements illustrates the sequence: the delegation was signed on September 24, the cessation retroacts its effects to September 28, and its official publication did not arrive until October 15.
Competence framework and publicity
The deputy mayoralty is a position of free appointment by the Mayor among the councilors of the corporation, and its revocation is part of the mayor’s organizational powers. Article 44 of Royal Legislative Decree 2568/1986 requires the publication of resolutions of this nature in the provincial official gazette, so that the agreement acquires general publicity and effectiveness against third parties.
The City Council of Barbadás, located in the region of Ourense, is thus left with a change in its government structure: the affected councilor loses the delegated competencies they held and the remuneration associated with the deputy mayoralty, while the Mayor’s office directed by Xosé Carlos Valcárcel Doval maintains the power to reorganize the delegations.
The decision has a direct impact on the internal organization of the council and the distribution of management areas among the members of the government team. For the residents, this translates into a modification of municipal responsibilities reflected in the official gazette and which may affect the processing of matters assigned to the dismissed councilor.
