Baralla and As Nogais share secretary-intervention after Decree 91/2026

The Council of the Xunta de Galicia approved Decree 91/2026, of 3 August, which authorises the voluntary grouping of the municipalities of Baralla and As Nogais, in the province of Lugo, for the shared maintenance of the secretary-intervention post, reserved for local government officials with national accreditation. The provision, signed by the president Alfonso Rueda Valenzuela and by the councillor for the Presidency, Justice and Sports, Diego Calvo Pouso, was published in the Official Journal of Galicia (DOG) No. 152, of 13 August 2026, pages 44403 to 44405.

The two councils agreed to give final approval to the constitution of a voluntary grouping to jointly maintain a single post reserved for these officials and submitted the file to the Xunta de Galicia for approval. The competence to agree on the constitution and dissolution of these groupings corresponds to the autonomous communities, in accordance with Article 92.bis of Law 7/1985, of 2 April, regulating the bases of local government, and with Royal Decree 128/2018, of 16 March, which regulates the legal regime of local government officials with national accreditation.

In the regional sphere, the figure is governed by Articles 165 et seq. of Law 5/1997, of 22 July, on the local administration of Galicia, and by Articles 11, 12, 13 and 16 of Decree 49/2009, of 26 February. The prescribed procedures were followed in the file, and reports were requested from the Provincial Deputation of Lugo and the Government Delegation in the Autonomous Community of Galicia, as well as the proposal for the classification of the resulting post.

A single secretary post for two municipalities

With the approval of the decree, which includes the statutes of the grouping as an integral part of the file, Baralla and As Nogais now share a single secretary-intervention post, a formula designed to guarantee the provision of the service in small municipalities at a lower cost. The competence to approve the grouping corresponded to the Council of the Xunta de Galicia, at the proposal of the head of the department responsible for local government affairs, after deliberation at its meeting of 3 August 2026.

Classified post and assigned staff

The reserved post resulting from the grouping is classified as follows:

• Post: secretary class 3.
• Subscale: secretary-intervention.
• Method of provision: competition.
• Level of destination supplement: 28.

The decree assigns Sandra Díaz Álvarez, a local government official with national accreditation belonging to the secretary-intervention subscale, to the new post of secretary class 3, and revokes the temporary appointment she held for the performance of the reserved post of secretary class 3 in the municipality of Baralla.

Time limits for appeal

Against this act, which exhausts the administrative channel, the following may be lodged:

• Contentious-administrative appeal within two months from publication before the Contentious-Administrative Chamber of the High Court of Justice of Galicia.
• Optionally, an appeal for reconsideration within one month before the body that issued the act, in accordance with Articles 123 and 124 of Law 39/2015.
• Local entities may submit a prior request within two months, in accordance with Article 44 of Law 29/1998, of 13 July.

The grouping between Baralla and As Nogais is part of the strategy to make the management of the least populated municipalities sustainable: sharing the mandatory national habilitation posts allows the quality of public services to be maintained by distributing the burden among several municipalities. The measure directly affects two municipalities in the Lugo mountains and constitutes a model that other small municipalities can replicate.
