Bailén eases the subdivision of the PP-2 industrial sector

The Bailén City Council (Jaén) has definitively approved the modification of the Partial Planning Plan for sector PP-2 of the PGOU (General Urban Planning Plan), submitted via private initiative, in a plenary session held on November 29, 2024, by absolute majority. The agreement, signed by Mayor Luis Mariano Camacho Núñez, is published in the Official Gazette of the Province of Jaén number 175, dated September 9, 2026, under reference 2026/4033.
The modification flexibilizes the parceling rules of the estate: it eliminates the prohibition on segregating plots and reduces the minimum buildable plot size for industrial subzone I-3 from 500 to 300 square meters, with a minimum road frontage that changes from 20 to 12 meters. The document is deposited in the city council’s registry of urban planning instruments and can be consulted on the Transparency Portal of its Electronic Office.
Regulatory Framework
The Bailén PGOU was definitively approved by the Provincial Urban Planning Commission on June 5, 1992 (BOP no. 198, August 28, 1992) and partially adapted to the LOUA by agreement of the Plenary on November 26, 2009. The Partial Plan for sector PP-2 was definitively approved on November 29, 1993 (BOP of April 12, 1994).
The publication is carried out in accordance with Article 45 of Law 39/2015, of October 1, on Common Administrative Procedure, and Article 70.2 of Law 7/1985, of April 2, Regulating the Bases of Local Government, by referral of Article 83.2 of Law 7/2021, of December 1, for the Promotion of Territorial Sustainability of Andalusia (LISTA).
What changes in sector PP-2
The modification affects two sections of the Partial Plan’s Planning Report:
- Segregation of plots: where the segregation of plots graphed in the plans was previously prohibited, it is now permitted provided they comply with the minimum plot size established for each subzone.
- Aggregation: the aggregation of up to two plots is maintained under the limitations of the Particular Zone Regulations, and more than two via a Detailed Study.
- Industrial Subzone I-3: the minimum buildable plot is reduced from 500 to 300 m², the minimum road frontage from 20 to 12 meters, and it is required that the shape allows for the inscription of a circle 12 meters in diameter.
Appeals and Deadlines
A contentious-administrative appeal may be filed against the agreement before the Contentious-Administrative Chamber of the High Court of Justice of Andalusia, based in Granada, within two months from the day following the publication of the announcement, pursuant to Article 46 of Law 29/1998, of July 13, of the Contentious-Administrative Jurisdiction. The announcement was signed in Bailén on August 25, 2026, by the secretary Ildefonso Cruz Cabrera.
The reduction of the minimum plot size and the opening of segregation facilitate the establishment of small and medium-sized industries within the industrial estate, by allowing smaller lots that are more adaptable to smaller companies. The measure, driven by private initiative, can stimulate the occupation of sector PP-2 and attract new economic activity to the municipality.
