Baeza approves the ordinance regulating street trading and the street market.

The Baeza City Council has definitively approved the modification of the Municipal Ordinance Regulating Street Commerce in the municipal area, which establishes the rules for the street market, street trading and itinerant commerce. The announcement is published in the Official Bulletin of the Province of Jaén number 157, of 14 August 2026, with the official reference 2026/3916, signed by the mayor Pedro Javier Cabrera Rentero.

The Municipal Plenary initially approved the modification at its ordinary session of 25 September 2025; after the public exhibition procedure, in which claims were submitted, the Plenary resolved them at its ordinary session of 30 July 2026, following a report from the Commerce Information Committee, and made the agreement final, in accordance with articles 22.2.d and 70.2 of Law 7/1985, of 2 April. The regulation is based on Legislative Decree 2/2012, of 20 March, the consolidated text of the Street Commerce Law of Andalusia, which incorporates Directive 2006/123/EC; its full text, with four annexes, is made public for general information.

An authorisation regime for three modalities

The ordinance distinguishes three modalities: the street market, in grouped stalls with a set frequency; street trading, in isolated, demountable stalls and without a set frequency; and itinerant commerce, along fixed routes using transportable or mobile means. Occasional fairs and markets, traditional flower, plant and animal markets, distance, automatic and door-to-door sales, and handicrafts under Law 15/2005 are excluded.

Engagement requires prior municipal authorisation, valid for fifteen years and renewable only once. The requirements for applying are:

• Being registered for the Economic Activities Tax and up to date with tax obligations to the State, the City Council and the Social Security.
• Having civil liability insurance and, where applicable, the certificate as a food handler.
• In the case of third-country nationals, proving residence and work authorisations.

Ownership is personal: the authorisation may be transferred, after a minimum of five years, to first-degree relatives or spouses, and a single exchange of stalls between holders is permitted. Unjustified absence on more than four consecutive days or nine alternate days per year is considered tacit waiver.

The street market: 103 stalls every Tuesday at the Plaza de Toros

The market will be held every Tuesday of the year on the esplanade of the Baeza Bullring, from 7:00 a.m. to 3:00 p.m., opening to the public at 9:00 a.m. It will have 103 stalls of between 4 and 12 linear meters; the facilities will be demountable and must be removed, leaving the space clean, within the two hours following closing. The award is governed by a 100-point competitive scoring system, with a public draw in the event of a tie, which values investment (up to 20 points), accredited experience (1.5 points per year, maximum 30), training, quality labels, consumer arbitration, membership in sector associations, social policy factors and innovative merchandise. Having been sanctioned by a final decision subtracts 3 points.

Street and itinerant trade: streets and schedules

Street trade may be carried out every day of the year, from 10:00 a.m. to 10:00 p.m., at the following locations:

• In Baeza: Paseo de la Constitución, Plaza Rey Fernando III, calle San Andrés, Plaza José de León, calle Alcalá, Parque Barrio de Andalucía, calle Cardenal Dávalos, calle Azulejos, Paseo del Arca del Agua, Polideportivo municipal (zona de la Hípica) and Avenida de Andalucía (Paseillos).
• In the outlying districts: calle La Romería (La Yedra); calle Mayor and Plaza de la Constitución (Puente del Obispo); and Plaza de la Constitución (Las Escuelas).

Itinerant trade is authorized from Monday to Friday, from 9:00 a.m. to 2:00 p.m., on all streets of the city except the areas excluded in Annex 4, and in all the outlying districts of La Yedra, Puente del Obispo and Las Escuelas. Any change for reasons of public interest will be communicated to the holders 15 days in advance.

Infractions, penalties and appeals

The sanctioning regime distinguishes minor, serious and very serious infractions, with a warning or fine of up to 1,500 euros, from 1,501 to 3,000 euros and from 3,001 to 18,000 euros; serious and very serious infractions may also add revocation of the authorization and confiscation of merchandise and means, and the limitation period is two months, one year and two years. The agreement may be appealed through administrative litigation before the Contentious-Administrative Chamber of the High Court of Justice of Andalusia, based in Granada, within two months from publication, in accordance with Article 46 of Law 29/1998. The ordinance will enter into force once fully published in the provincial bulletin.

The regulation directly affects street vendors in Baeza and its outlying districts and, in particular, the holders of the 103 market stalls, who now have their location, schedules, award criteria and obligations set in writing. This publication closes a process opened in September 2025, and the sector is provided with a stable and predictable framework, in line with Andalusian regulations on street trading.
