Bañón City Council expropriates by urgency a property in imminent ruin

The Bañón City Council has published in the Official Gazette of the Province of Teruel the initial approval of the expropriation by urgent procedure of an urban property located at Calle Mayor No. 7 in said town in Teruel. The agreement, adopted by the Municipal Plenary on August 4, 2026 and registered under No. 2026-2461, is framed within the need to guarantee the safety of pedestrians and neighboring properties given the declared state of ruin.

The property was declared in a state of imminent ruin within the framework of File No. 9/2025, under the protection of Article 258 of the Consolidated Text of the Urban Planning Legislation of Aragon (TRLUA). Given the owner’s inactivity in fulfilling their urban conservation duties, the council opted to activate the urgent expropriation procedure to proceed with the subsidiary demolition of the building.

The expropriated asset has the following registry and cadastral characteristics:

  • Cadastral owners / interested parties: Ana Bartomeu Segui and María Francisca Bartomeu Segui.

Valuation and fair compensation

The fair compensation set for the expropriation is €0.00, a figure resulting from applying the reduction for subsidiary demolition costs. In other words, the market value of the property is fully offset by the expenses that the council will assume for the demolition of the structure in ruin.

Public information and claims period

In compliance with Article 18 of the Forced Expropriation Law (of December 16, 1954) and Article 17 of the Regulations of said Law (approved by Decree of April 26, 1957), a fifteen-day public information period is opened. During that period, interested parties may:

  • Examine the file at the municipal offices of the Bañón City Council.
  • Submit data allowing the correction of errors in the list of affected owners.
  • File claims regarding the appropriateness of the occupation or disposal of the asset.

The notice, dated in Bañón on August 12, 2026, is signed by the Mayor, José Ángel Sancho Marco, and is published as a substitute notification to interested parties in the event that personal notification of the granting of the hearing procedure cannot be carried out.

Relevance of the ruling

This case illustrates the legal tool that the compulsory expropriation regulations place at the disposal of municipalities to act against properties in a state of ruin whose owners deliberately fail to comply with their conservation obligations. Expropriation with zero compensation, offset by the cost of demolition, protects the community without transferring the economic burden of a negligent owner to the public treasury. In a small municipality like Bañón, with barely a handful of inhabitants, inaction in the face of a building in ruins can pose a real risk to neighbours and passers-by, which makes this type of measure an urgent necessity for the protection of the general interest.
