Por FactBox Admin

The Council of Ministers approved on November 3 Royal Decree-Law 32/2026, an extraordinary aid regime for the victims of the Urda (Toledo) railway accident of October 28, 2026, and which guarantees equitable access to goods and services in emergencies. The regulation is published in the Official State Gazette (Boletín Oficial del Estado) no. 274, of November 4, 2026, in Section I (reference BOE-A-2026-23104), and entered into force on the day of its publication.
The accident occurred at kilometer 118 of line 14-010 Madrid-Puerta de Atocha-Almudena Grandes-Sevilla Santa Justa, near the town in Toledo. According to the published text, an AVE 2080 train from Renfe Viajeros SME SE, with 397 passengers on board, collided at high speed from behind into the Iryo 6076 train, operated by ILSA (Intermodalidad de Levante, SA), which was carrying 147 passengers. The impact caused the derailment and crushing of four cars from the rear composition of the Iryo, which fell down an embankment, resulting in 69 deaths and more than 100 injuries.
The regulatory response is based on a previous framework listed by the royal decree-law itself:
- Law 1/2014, of February 28, which incorporated the right of railway accident victims to comprehensive care.
- Royal Decree 627/2014, of July 18, on assistance to railway accident victims and their families.
- Law 38/2015, of September 29, on the railway sector, and Regulation (EU) 2021/782, which recognizes immediate financial advances.
- The precedent of Royal Decree-Law 1/2026, of January 27, for the victims of Adamuz (Córdoba) and Gélida (Barcelona).
Amounts for death and injuries
Article 3 sets fixed amounts, regardless of the subsequent determination of liability. For each deceased person, 72,121.46 euros will be paid. In the case of bodily injuries, the amounts are scaled across fourteen categories of the Mandatory Passenger Insurance scale:
- Category 1: 84,141.70 euros; category 2: 60,101.22 euros; category 3: 54,091.08 euros.
- Categories 4 to 7: 48,080.96, 42,070.84, 36,060.72 and 30,050.60 euros.
- Categories 8 to 11: 24,040.48, 18,030.36, 12,020.24 and 9,015.18 euros.
- Categories 12 to 14: 7,212.14, 5,409.10 and 2,404.04 euros.
Beneficiaries will be the injured or deceased persons who were traveling as passengers, drivers, or onboard personnel; for deaths, an order of priority is established for indirect victims (spouse or partner, children, parents, ancestors, and siblings). Railway companies must send the list of occupants to the instructing body within 15 days.
Advance of civil liability and assistance offices
The first additional provision allows for the request of additional aid as an advance on civil liability compensation, for the same amount as the ordinary aid. The State subrogates the credit rights up to the amount advanced and, if the final compensation is lower, the beneficiary does not have to return the difference. Management is the responsibility of the Secretary of State for Transport and Sustainable Mobility, under the instruction of the Directorate General for Road and Rail Transport; applications shall be submitted within a period of three months from the resolution establishing the procedure.
Furthermore, Comprehensive Care Offices are created in the Government Delegations and Sub-delegations and Insular Directorates of the communities where affected persons reside. The text includes other measures: protection of workers who were unable to attend their workplace, exceptional consideration as assimilated to a work accident for temporary disability processes initiated before November 30, 2026, and for disability, death, and survivor pensions.
Price limit in the face of anomalous demand
Chapter II modifies Royal Legislative Decree 1/2007, of November 16, and introduces the new article 20 ter of the General Law for the Defense of Consumers and Users. During an emergency, increases over the maximum price offered in the thirty days prior to the unforeseen situation may not be applied, with specific references for seasonal goods and for services with regulated tariffs. The measure is activated following the declaration of a zone seriously affected by a civil protection emergency under Law 17/2015, of July 9, or by Agreement of the Council of Ministers, and overcharging grants the right to an automatic refund.
The fifth additional provision applies this limitation to services affected by the interruption of the Madrid-Andalucía line, with initial validity until November 10, 2026, and a possible extension by agreement of the Executive. Measures affecting the freedom of transport pricing shall not be applied until express authorization is obtained from the European Commission. The whole is financed by two extraordinary credits of 15,309,165.24 euros each.
The royal decree-law arrives with the Courts dissolved by Royal Decree 806/2026, of October 5, which forces the Government to legislate by urgency and refers parliamentary control to the Permanent Deputation of the Congress. For those affected, the practical impact is immediate: it opens the way to collect payments without waiting for judicial proceedings and extends protection to passengers of the line while it remains suspended.
