Asturias maintains the denial of organic production grants for 2025

The Regional Ministry of Rural Environment and Agricultural Policy of the Principality of Asturias has resolved to maintain the denial of aid for Intervention 6503. Organic Production, 2025 campaign, to a holder with NIF B33333402, despite the fact that they managed to remedy the initial reason for denial. The decision is detailed in the Resolution of August 12, 2026, published in the Official Gazette of the Principality of Asturias number 165, of August 26, 2026, with code 2026-06931.

The procedure is part of the call for direct payments to agriculture and livestock and rural development interventions of the Integrated Management and Control System (SIGC), approved by resolution of April 7, 2025, and published in the BOPA of April 16, 2025. In the 2025 campaign, a total of 139 annual payment applications were submitted for the adoption and maintenance of organic farming practices, of which 2 withdrawals were recorded.

A case of remedy and a new non-compliance

Through the Resolution of March 9, 2026, published in the BOPA of March 23, 2026, the Ministry initially denied aid to the holder with NIF B33333402 for failing to meet the condition of being an active farmer. The interested party submitted complementary documentation within the deadline, after whose analysis compliance with said requirement was verified, thereby remedying the initial reason.

However, upon performing the corresponding recalculation of commitments, it was found that another non-compliance persisted: the same product was declared for both organic and non-organic production within the same Autonomous Community. Therefore, the resolution maintains the denial of aid for this new reason.

Competence and regulatory framework

The competence to resolve the procedure corresponds to the Director General of Livestock and Agricultural Health, by virtue of the delegation of powers approved by resolution of September 16, 2025 (BOPA no. 187, of September 29, 2025), as it concerns the granting and denial of subsidies within the scope of the management of the European Agricultural Fund for Rural Development (EAFRD).

The resolution is based on the regulations applicable to subsidies, including:

• Law 38/2003, of November 17, General Law on Subsidies, and its regulation (Royal Decree 887/2006).
• Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
• Law 2/1995, of March 13, on the Legal Regime of the Administration of the Principality of Asturias.
• The regulatory bases of the call of April 7, 2025.

Appeals and effects

This act concludes the administrative process. An appeal for judicial review may be filed against it before the Administrative Chamber of the High Court of Justice of the Principality of Asturias within two months of its notification, without prejudice to the possibility of previously filing an optional appeal for reversal before the same body within one month; both appeals cannot be pursued simultaneously.

The decision affects a farmer who depends on these agri-environmental payments to sustain their organic farming operation, and highlights the rigor with which the Asturian Administration verifies the commitments of organic production funded by European funds, even when the applicant manages to prove their status as an active farmer.
