Asturias declares the land consolidation of Santa Ana to be of public utility
Por FactBox Admin

The Governing Council of the Principality of Asturias has declared the private land consolidation of the Santa Ana area, in the municipality of Cangas del Narcea, to be of public utility. The decision is formalized in Decree 64/2026, of September 18, published in the Official Gazette of the Principality of Asturias (BOPA) on October 2, 2026, in issue number 191, within section I of General Provisions. The regulation fixes the perimeter of the area, establishes the minimum cultivation unit, and subjects any work within that scope to prior authorization.
The file began with the request from the group of owners of Santa Ana, who presented to the Ministry of Rural Environment and Agricultural Policy the problems posed by the property structure in the area. Through a resolution dated March 7, 2023, that ministry authorized the start of the procedure regulated in Decree 80/97, of December 18, which establishes the procedure for private land consolidation, considering that its execution is of public, social, and economic interest.
The Agricultural Infrastructure Service verified the fulfillment of the technical and procedural requirements of article 7 of that decree and, in view of the work presented, concluded the convenience of carrying out the consolidation for reasons of public utility, in accordance with the aforementioned Decree 80/97 and Law 4/89, of July 21, on Agricultural Planning and Rural Development. The text bears the signature of the President of the Principality of Asturias, Adrián Barbón Rodríguez, and the Minister of Rural Environment and Agricultural Policy, Marcelino Marcos Líndez.
Perimeter and delimitation of the area
Article 2 of the decree establishes the perimeter of the area, which is located entirely within the municipality of Cangas del Narcea and whose limits are:
- North: lands of Otero.
- South: lands of Corias and El Piñolo.
- East: lands of La Gubia.
- West: lands of Carcedo and Santa Ana.
Minimum cultivation unit
Article 3 fixes the surface area of the minimum cultivation unit for the Santa Ana area:
- 70 ares for the minimum agricultural cultivation unit.
- 10 hectares for forestry cultivation.
Prior authorization for works and entry into force
From the entry into force of the decree, any work or improvement intended to be carried out within the perimeter of the area will require the prior authorization of the Ministry of Rural Environment and Agricultural Policy, according to article 4. The first final provision empowers the head of that ministry to issue the complementary provisions required for the execution of what is established.
The second final provision establishes that the decree enters into force on the same day as its publication in the BOPA, that is, October 2, 2026.
The declaration of public utility opens the way to reorganize the rural property of Santa Ana and enables, in subsequent phases, the bases and the consolidation agreement. For the owners in the area, the immediate effect is twofold: their plots fall within a perimeter subject to a special intervention regime, and any work or improvement will require permission from the competent regional ministry.
