Por FactBox Admin

The Superior Audit Office of the Federation summoned to an initial hearing two companies participating in construction tenders, an emulsions firm, and a former executive of the National Water Commission for collusion, diversion of public resources, and the use of false information in works for the Eastern Emitting Tunnel and in Jalisco. The summons was published by edict in the Official Gazette of the Federation on October 22, 2026, under procedures DGSUB/A.1/2492/07/2026, DGSUB/A.1/2529/08/2026, DGSUB/A.1/2530/08/2026, and DGSUB/A.1/2552/09/2026. The hearings will be held on December 15, 2026, at the auditing body’s headquarters in Tlalpan, Mexico City.
The edict is signed by the Director of Substantiation “A.1” of the General Directorate of Substantiation of the Legal Affairs Unit, Alfonso Javier Arredondo Huerta, based on articles 14, 16, 79, 108, and 109, fraction III, of the Political Constitution of the United Mexican States; 9, fraction III, 112, 113, 188, 193, 194, 198, and 209 of the General Law of Administrative Responsibilities; and 315 of the Federal Code of Civil Procedure. The summons derive from agreements dated September 28 and October 5, 2026, which ordered notification by edict because it was not possible to locate the alleged responsible parties at the provided addresses, despite exhausting all efforts.
This is the initial stage of the administrative responsibility procedure, in which no sanction yet exists: the parties must appear to testify and offer evidence before the General Directorate of Substantiation.
Collusion in state tender 007/2023
- Construcciones Mirot, S.A. de C.V. and Tripoli Emulsiones, S.A. de C.V., in their capacity as participants in the procurement process of state public tender 007/2023, which resulted in contract CEA-CON-EST-LP-114-23.

Diversion of resources and false data in the Eastern Emitting Tunnel
- Mario Andrés Terres Trejo, in his capacity as Director of the Construction Area of the General Coordination of Special Supply and Sanitation Projects and subsequently of the General Sub-directorate of Drinking Water, Drainage, and Sanitation of the National Water Commission, as well as site resident for Sections III and IV of the Túnel Emisor Oriente.
- He is charged with the diversion of public resources, as provided for in Article 54 of the General Law of Administrative Responsibilities, in proceedings DGSUB/A.1/2529/08/2026 and DGSUB/A.1/2530/08/2026, with hearings at 10:00 and 11:00 hours.
- Constructora Mexicana de Infraestructura Subterránea, S.A. de C.V., the contractor for the same works, faces charges for the use of false information, as provided for in Article 69 of the same law, with hearings at 10:30 and 11:30 hours.
- The works were covered under the mixed public works contract SGAPDS-GIHP-DFMEXHGO-08-008-RF-AD, for the executive project and construction of the tunnel in Mexico City, the State of Mexico, and the State of Hidalgo.
Unlawful participation in tender CEA-CON-EST-LP-115-23
- Construcciones Mirot, S.A. de C.V. and Tripoli Emulsiones, S.A. de C.V. were also summoned as participants in tender CEA-CON-EST-LP-115-23, for unlawful participation in the tender as provided for in Article 67 of the General Law of Administrative Responsibilities.
- The proceeding is DGSUB/A.1/2492/07/2026, with hearings at 09:00 and 09:30 hours on December 15, 2026.
Rights of the summoned parties and procedural route
- They may provide a statement in writing or verbally, offer evidence, defend themselves personally or with a defense attorney, and refuse to testify against themselves; if they do not have a defense attorney, one will be appointed ex officio.
- Certified copies of the Report of Presumed Administrative Responsibility and the case file are available on business days, from 9:00 to 15:00 and from 16:30 to 18:30 hours.
- They must designate an address for receiving notifications in Mexico City; should they fail to appear, the proceeding will continue without their presence and notifications will be made via public notice boards.
- The hearings will take place on the sixth floor of building “A”, Carretera Picacho Ajusco 167, colonia Ampliación Fuentes del Pedregal, C.P. 14110, Tlalpan.
The summons formally opens the path toward potential sanctions for serious administrative offenses and acts by private parties linked to those offenses, a scenario that could result in disqualification from contracting public works. For the treasury, the case places two major hydraulic infrastructure contracts under review—the Túnel Emisor Oriente and the Guadalajara conduction line—and a mid-level manager of Conagua as the alleged party responsible for the diversion of resources.
