Ares aproba definitivamente a modificación da ordenanza reguladora de terrazas

The Ares City Council has definitively approved the modification of the ordinance regulating the installation of terraces in the municipality, a change that directly affects hospitality establishments occupying public roads. The approval was published in the Official Gazette of the Province of A Coruña (BOP) number 198, corresponding to Friday, October 16, 2026, in the Local Administration section, under announcement number 2026/6597. The text was signed in Ares on October 13, 2026, by the mayor-president, Julio Ignacio Iglesias Redondo.

The modification had been initially approved in the ordinary plenary session on August 31, 2026, and subsequently submitted for public information via an announcement in BOP number 169, dated September 4, 2026, with a 30-day exhibition period. As no objections were presented, the initial agreement was automatically elevated to definitive, as provided for in the initial approval edict itself. The reference regulation supporting this procedure is Article 17 of the consolidated text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5.

What changes in the text of the ordinance

The modification focuses on a single precept, Article 4, dedicated to prohibitions and limitations on the use of authorized terraces on public roads. The stated objective is to provide greater legal certainty to the persons and entities included in the scope of application of the ordinance, through the removal of a part of the current text.

  • The exception that allowed the installation of image and sound reproduction devices and the holding of shows or musical performances when express authorization from the competent administration existed is removed.
  • The prohibition becomes absolute: the installation of any type of image and sound reproduction devices, as well as the holding of shows or musical performances, is strictly prohibited.
  • The rest of the ordinance’s articles remain unchanged.

Background and processing

The ordinance regulating the installation of terraces in the municipality of Ares was published in BOP A Coruña number 98, on May 25, 2022, and is the text that is now being amended. The administrative path of the modification was as follows:

  • August 31, 2026: initial approval in the ordinary plenary session of the Ares City Council.
  • September 4, 2026: publication of the public information announcement in BOP number 169, under announcement number 2026/5717.
  • 30 days: public exhibition period, with no claims or suggestions presented.
  • October 13, 2026: signing of the definitive approval announcement by the mayor-president.
  • October 16, 2026: publication of the full modification in BOP number 198.

Scope for the hospitality sector

The change eliminates the clause that previously allowed for an express authorization to install sound or image equipment on terraces and to schedule musical performances in those spaces. With the new wording, this possibility disappears from the regulatory text, meaning that the prohibition no longer admits exceptions linked to a permit from the competent administration. The modification therefore affects both the owners of establishments with terraces and all neighbors in the areas where these occupations of public roads are installed.

The published announcement contains the resulting text of Article 4 and is referenced with number 2026/6597, which is the official identifier with which the document can be consulted in the provincial bulletin.

The entry into force of this modification represents a tightening of the conditions for the use of terraces in Ares and closes the debate opened during the public information period in September. For the hospitality business owners of the municipality, the change implies reviewing any plans for the installation of sound equipment or musical programming on terraces, while neighbors gain clearer regulatory protection against noise and shows in these spaces.
