Arbancón requires a 250 euro deposit for works on unique pavements

The Entity of Arbancón has definitively approved the Municipal Ordinance Regulating the Bond for the Protection of Singular Pavements in Works, which requires developers and contractors to deposit a refundable guarantee of 250 euros before starting any action that could damage the municipal public domain. The regulation, adopted by agreement of the Plenary on June 25, 2026, is published in the Official Gazette of the Province of Guadalajara on August 26, 2026 (reference 2026_2253).
As no claims were filed during the public exhibition period, the plenary agreement was automatically elevated to definitive, and its full text is made public in compliance with Article 17.4 of the Revised Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5. The document appears signed in Arbancón on August 21, 2026, by the Mayor-President, Gonzalo Bravo Bartolomé.
Purpose and Scope of Application
The purpose of the ordinance is to ensure the correct cleaning, conservation, repair, or replacement of certain public pavements that are particularly sensitive to staining or deterioration during the execution of works. The requirement for the bond applies throughout the municipality to those works which, due to their execution, materials, machinery, traffic, stockpiling, or any other circumstance linked to their development, may cause damage, dirt, or affect the municipal public domain.
The guarantee is also required for actions subject to a responsible declaration or prior communication when they involve or may involve the occupation, use, deterioration, or direct affection of the municipal public domain or its assets, pavements, installations, or public services.
Amount, Constitution, and Return
The amount of the bond is set at two hundred and fifty euros (250.00 €). The guarantee must be constituted prior to the granting of the license or, where applicable, before the start of the corresponding action, and may be carried out in any of the forms admitted by Law.
- The bond is constituted before the license or the start of the work.
- Once the works are completed, the interested party may request its return.
- The return is agreed upon following verification by the municipal technical services that the affected pavement is in a correct state of cleanliness, conservation, and, if applicable, replacement.
Execution of the Guarantee
If, as a result of the works, stains, spills, dirt, defects, or deterioration occur on the public pavement, the City Council will require the obligated party to proceed with its adequate cleaning, repair, or replacement within the granted timeframe. In case of non-compliance, the council may execute the bond in whole or in part to cover the corresponding expenses.
If the cost of the municipal action exceeds the amount of the bond, the City Council may demand the corresponding difference from the obligated party through legally established means. The guarantee is refundable and non-taxable, and is independent of the Tax on Constructions, Installations and Works, the fee for granting urban planning licenses, and any other levies.
An administrative appeal may be filed against the agreement before the Administrative Litigation Chamber of the High Court of Justice of Castilla-La Mancha based in Albacete, within two months from the day following the publication of the announcement, in accordance with Article 46 of Law 29/1998, of July 13, on Administrative Litigation Jurisdiction.
The new ordinance provides the municipality with an agile instrument to protect its unique pavements against damage derived from works, transferring the responsibility to developers and contractors to leave the public space in its original state. With a moderate amount and refundable nature, the measure seeks to reconcile construction activity with the conservation of the urban heritage of Arbancón.
