Aragón sanciona a la residencia Virgen de Loreto de Huesca

The Department of Deregulation, Social Welfare and Family of the Government of Aragon has resolved the sanctioning procedure initiated against the entity Asistencia Geriátrica Argarot, owner of the Virgen de Loreto residence in Huesca, with a financial penalty and the adoption of measures to restore legality. The decision is notified via an announcement from the Technical General Secretariat published in the Official Gazette of Aragon (Boletín Oficial de Aragón) number 196, dated October 8, 2026, with official reference BOA20261008020.

The resolution takes the form of an Order from the Counselor of Deregulation, Social Welfare and Family that exhausts the administrative route, issued following the procedure processed by the Technical General Secretariat of the same department. The affected center is the Virgen de Loreto residence, located at calle Tenerías, 11 bajos, 22001, Huesca.

As personal notification to the entity could not be carried out, the department resorts to notification by announcement under articles 44 and 45 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations (LPAC). The announcement does not detail the amount of the fine, which shall be paid according to the deadlines of the General Collection Regulations.

A sanction with restoration measures

The official text confirms that the Order is not limited to the financial penalty: it also orders the adoption of measures to restore legality at the center. These measures must be executed within two months from the date of notification.

The entity has electronic access to the full Order issued in the procedure and may appear to consult it at the offices of the administrative body, located at plaza del Pilar, 3, building B, 5th floor, Social Services Planning Service, in Zaragoza.

Deadlines for compliance and appeal

Against the Order, which exhausts the administrative route, the entity may file:

  • A contentious-administrative appeal before the High Court of Justice of Aragon, within two months from the day following the notification, in accordance with articles 8, 10, and 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
  • An optional appeal for reversal (recurso potestativo de reposición) before the Counselor of Deregulation, Social Welfare and Family, within one month from the notification, according to articles 123 and 124 of the LPAC.

The payment of the financial penalty shall be subject to the deadlines set forth in the General Collection Regulations, approved by Royal Decree 939/2005, of July 29.

Effects of notification and signature

The notification shall take effect as of its publication in the “Official State Gazette”. The announcement was signed in Zaragoza on September 29, 2026, by the Technical General Secretary of the Department of Deregulation, Social Welfare and Family, Manuel Díaz Muñia.

The publication closes the administrative route of the sanctioning proceedings against the manager of the Huesca center and opens a fixed period for its challenge. For the users and families of the residence, the announcement confirms that the resolution includes both the fine and the obligation to correct the detected deficiencies within a maximum period of two months.
