Aragón expropia terrenos en Boltaña y Sieste para la depuradora de Margudgued

The Government of Aragon has opened the public information period for the list of assets and rights to be expropriated for the execution of phase 2 of the wastewater treatment plant (EDAR) of Boltaña-Margudgued, in the province of Huesca. The resolution is signed by the Technical General Secretariat of the Department of Environment and Tourism and is published in the Official Gazette of the Province of Huesca number 191, dated Tuesday, October 6, 2026, with official reference BOPH-2026-191031. The same announcement summons the affected owners for the drafting of the pre-occupation minutes, scheduled for November 18, 2026, at the Boltaña City Council.

A procedure with a declaration of urgency

The treatment works planned in Boltaña and Margudgued have the declaration of general interest of the State granted by article 36.5 of Law 10/2001, of July 5, of the National Hydrological Plan. Furthermore, they are included in the Comprehensive Treatment Plan of the Aragonese Pyrenees, approved by Agreement of the Government of Aragon on November 18, 2008, which grants them the declaration of public utility and social interest, the necessity of occupation, and urgency for expropriation purposes.

The origin of the collaboration dates back to the Collaboration Agreement-General Protocol signed on October 2, 2007, between the Ministry of Environment and the Autonomous Community of Aragon, later specified in the Specific Agreement of April 8, 2008, for the development of the National Water Quality Plan 2008-2015. After the administrative concession route failed, the Government of Aragon agreed on December 11, 2018, to undertake the works through construction contracts between 2019 and 2024.

The expropriation power belongs to the Autonomous Community of Aragon, which exercises it through the Department of Environment and Tourism due to its link with the Aragonese Water Institute. The urgency of the procedures was declared by Agreement of May 18, 2022, published via Order AGM/867/2022, of June 2 (BOA number 116, of June 17, 2022), and the start of the 14th 7th 3rd compulsory expropriation procedure was resolved by Order of September 10, 2026, from the Councilor for Environment and Tourism.

Fifteen business days to submit allegations

The resolution opens a period of fifteen business days from the date of the final publication —Official State Gazette, Official Gazette of Aragon, Official Gazette of the Province of Huesca, town hall notice boards, the province’s highest circulation newspaper, and the websites of the Aragonese Water Institute and the department— for interested parties to submit allegations to the General Technical Secretariat and provide background information to rectify errors in the material or legal description of the properties.

Those who hold real rights or economic interests and may have been omitted from the list may also file allegations until the day the respective prior report is drawn up, in accordance with Article 56.2 of the Regulations of the Compulsory Expropriation Law.

Appearances on November 18

The owners must go to the premises of the affected town halls on the indicated days and times, provided with a national identity document and documentation proving ownership of the property —land registry summary note, public deed, cadastral certification, or any other reliable means—. Representatives of the Administration, experts, and the mayor or the delegated councilor will attend the act, and the owners may exercise the rights recognized to them by article 52.3 of the Compulsory Expropriation Law.

The resolution was signed in Zaragoza on September 25, 2026, by the Technical General Secretary, Carmen Sanz Gandasegui.

The publication directly affects the owners of Margudgued and Sieste, who have a limited period to review the areas and file objections before the preliminary reports are drawn up. The declared urgency shortens the procedures and places the effective occupation of the land in the immediate horizon of phase 2 of the sewage treatment plant.
