ANA updates registration regulations for specialists for environmental impact studies

ANA actualiza reglamento de inscripción de especialistas para estudios de impacto ambiental

The National Water Authority (ANA) approved the “Regulation for the registration and contracting of professionals in the roster of specialists of the National Water Authority”, through Chief Resolution No. 0233-2026-ANA, signed in San Isidro on September 10, 2026, and published in the Official Gazette El Peruano on Sunday, September 13, 2026. The regulation, signed by the head of the entity, Juan Carlos Castro Vargas, updates the framework regulating the professionals responsible for reviewing environmental impact studies linked to water resources.

The regulation repeals Article 2 of Chief Resolution No. 0231-2023-ANA, which had been modified by Chief Resolution No. 0027-2024-ANA, and replaces the current text with a proposal that, according to the resolution itself, systematically expresses the needs for the comprehensive evaluation of environmental management instruments and avoids operational gaps in institutional competencies.

The update is based on Article 81 of Law No. 29338, Water Resources Law, which requires a favorable opinion from the ANA for the approval of environmental impact studies related to water resources. Likewise, the Fourth Final Complementary Provision of Law No. 30327, modified by Legislative Decree No. 1570, empowers the entity to create the roster of specialists who will perform functions of reviewing environmental impact studies, supervision and accompaniment of the baseline, and technical opinions.

The proposal was prepared by the Directorate of Water Resources Quality and Evaluation and had the approval of the Directorate of the National Water Resources Information System, the Administration Office, and the Planning and Budget Office, in addition to the favorable opinion of the Legal Advisory Office.

Scope of the roster of specialists

Professionals registered in the roster will undertake tasks of reviewing environmental impact studies, supervision and accompaniment of the baseline, and the issuance of technical opinions, within the framework of the global environmental certification (IntegrAmbiente) provided for in Law No. 30327. The regulation is also linked to the Public Environmental Baseline created by Supreme Decree No. 004-2025-MINAM, managed by the Ministry of the Environment.

  • Supervision and accompaniment of the environmental baseline.
  • Issuance of technical opinions as appropriate.
  • Contracting, designation, and execution of tasks entrusted to third parties.

Complementary provisions

The regulation establishes that, for all matters not provided for, the Single Ordered Text of Law No. 27444, Law No. 32069, General Public Procurement Law, and the Civil Code shall apply supplementarily. The Administration Office may update, modify, incorporate, or remove the annexes of the regulation by means of a resolution.

The sole transitory provision sets a deadline of seven (07) calendar days for professionals currently registered in the roster to carry out a new registration in accordance with the new regulation. The resolution and its annex are published in the Official Gazette El Peruano and on the institutional portal of the ANA (www.gob.pe/ana).

Relevance

The update redefines the requirements and procedures for consultants and professionals to join the ANA roster of specialists, a key requirement for the approval of water and investment projects that require environmental certification. Professionals already registered must re-register within a short period, and new applicants must comply with the updated rules, which directly impacts the processing of environmental impact studies in the country.
