Almoster definitively approves the ordinance regulating the use of municipal facilities

The Plenary of the Almoster City Council has definitively approved the municipal ordinance regulating the use of municipal facilities and equipment, after the 30-working-day public information period closed without any allegations. The agreement, electronically signed by Mayor Josep Canals Anglès, is published in the Official Gazette of the Province of Tarragona on September 18, 2026, with the reference CVE 2026-08533 and six pages of regulatory text. The publication ends the administrative route and enables the filing of a contentious-administrative appeal before the contentious-administrative chamber of the High Court of Justice of Catalonia within a period of two months.
The provisional approval took place at the Plenary of the Corporation on July 8, 2026. The agreement was subsequently submitted for public information through edicts in the Official Gazette of the Province of Tarragona on July 27, 2026, in the Official Gazette of the Generalitat de Catalunya number 9714 on July 23, 2026, in the Diari de Tarragona on July 28, 2026, and on the municipal electronic office and the City Council’s transparency portal. Four spaces under a single regulation
The ordinance, officially titled the regulating ordinance for the use of municipal spaces, aims to regulate the conditions of use, the authorization regime, the rights and duties of users, the system of financial guarantees, and the sanctioning regime. It applies to all natural or legal persons, entities, associations, or collectives that request or make use of municipal spaces, which are public in nature and intended for cultural, social, educational, training, youth, or general interest activities.
The included facilities are:
- Espai Moster
- Municipal Theatre
- Espai del Forn
- Espai Jove
Authorizations, schedules, and deposits
The use of the spaces requires prior authorization from the Almoster City Council. The request must be submitted at least 7 working days in advance for activities requiring more planning and coordination, and 48 to 72 hours for talks or similar ordinary activities, preferably via the electronic office or the registry. An activity sheet with a descriptive report must be attached, including the description, date and time, assembly and disassembly, the requested space, the expected number of attendees, technical requirements, and the person responsible.
The ordinary hours of use are from 9:00 to 23:00 hours, with the possibility of exceptional extensions by express resolution for reasons of public interest or singular events. The City Council may require a deposit as a guarantee, in the amount set by the current fiscal ordinance of taxes for the use of municipal spaces; the refund is processed ex officio and, if there are no incidents, within a maximum period of 15 days from the end of the activity. Users must respect schedules and capacities, keep the space clean, be responsible for damages, and comply with safety regulations.
Sanctioning regime: from a warning to 2,500 euros
Infractions are classified as minor, serious, and very serious, and when a deposit has been required, the City Council may execute it totally or partially. The sanctions are:
- Minor: written warning, fine up to 250 euros, partial execution of the deposit, and corrective measures.
- Serious: fine from 251 to 1,250 euros, total or partial execution of the deposit, and corrective measures.
- Very serious: fine from 1,251 to 2,500 euros, prohibition of use for up to one year, total execution of the deposit, and requirement of complementary civil liability.
Exceeding capacity, economic damages, unauthorized activities, and the repetition of 10 minor infractions within the same year are considered serious. Serious or intentional damage, endangering safety, the illegal transfer of the space, and the repetition of 5 serious infractions in one year are very serious. The procedure complies with the local regime regulations and common administrative procedure, with a hearing, proportionality, and the presumption of innocence.
Video surveillance and specific infractions per facility
The spaces have video surveillance systems to guarantee security and protect municipal heritage. The processing of images is carried out in accordance with Regulation (EU) 2016/679 and Organic Law 3/2018, with informative signage, review only in case of an incident or possible infraction, and use as evidence in sanctioning proceedings.
The annex of the ordinance specifies the infractions for each facility. At Espai Moster, among others, the unauthorized manipulation of technical equipment and the alteration of electrical systems are typified; at the Municipal Theatre, access to dressing rooms and the technical booth without permission, the manipulation of sound, lighting, or stage machinery equipment, and the blocking of emergency exits; at Espai del Forn, the introduction of elements that deteriorate the heritage space and the alteration of protected architectural elements; and at Espai Jove, the consumption of prohibited substances, repeated uncivil attitudes, and violent acts. The ordinance also recognizes the social, cultural, and community role of local entities and associations and the municipal commitment to facilitate their access to spaces under appropriate and, whenever possible, preferential conditions.
With this regulation, Almoster unifies into a single text the rules of access, coexistence, and responsibility for all its public facilities, a measure that directly affects entities, associations, and residents who organize activities in the municipality. The regulation comes into force once definitively approved by the Plenary and published in the provincial bulletin, and will remain in effect until its express modification or repeal.
