Por FactBox Admin

The Aliseda City Council has approved the Ordinance regulating security and citizen coexistence, published in the Official Gazette of the Province of Cáceres number 0209, corresponding to Friday, October 30, 2026, within Section I of Local Administration (official reference BOP-2026-5085, pages 24650 to 24665). The regulation was signed in Aliseda on October 26, 2026, by the mayor-president, Raquel Liberal Martín, and establishes a sanctioning regime with fines of up to 3,000 euros. It will enter into force fifteen days after its full publication in the provincial gazette.
Competence Framework and Scope of Application
The text is supported by the regulatory power that article 4.1.a) of Law 7/1985, of April 2, Regulating the Bases of the Local Regime recognizes for city councils, and by article 84 of the same law, which allows for intervention in the activities of citizens through ordinances and proclamations. The capacity to define infractions and sanctions is based on articles 139 and following of that law, and the ordinance declares itself to be in accordance with the principles of good regulation of article 129.1 of Law 39/2015, of October 1.
The application is extensive: it covers the entire municipal district of Aliseda and all public spaces (streets, sidewalks, squares, green areas, parking lots), as well as urban furniture and assets of other administrations intended for the public, such as containers, fences, signs, kiosks, terraces, or bike racks. It applies to all persons present in the municipality, regardless of their administrative legal status, and also to the conduct of minors, with the possibility that parents, guardians, or custodians may be held liable in cases of intent, fault, or negligence.
Fines of up to 3,000 euros and three levels of infractions
The sanctioning chapter distinguishes between very serious, serious, and minor infractions, with the following maximum amounts:
- Very serious infractions: up to 3,000 euros.
- Serious infractions: up to 1,500 euros.
- Minor infractions: up to 750 euros.
Defined as very serious are the recidivism of serious offenses, the commission of three serious infractions within one year, the access to or use of municipal premises outside of hours or without authorization, the supply of alcoholic beverages on public roads without authorization—under no circumstances to minors—, the manipulation or serious damage to water supply networks and elements, and conduct that generates a serious risk to the safety of people, public health, or the environment. Serious infractions include the improper use of municipal roads, spaces, and equipment, the consumption of alcohol in the street, depositing garbage outside of containers, camping outside of designated areas, and depositing furniture next to containers. All other non-specified breaches are considered minor.
Very serious infractions prescribe after three years, serious ones after two, and minor ones after six months; sanctions prescribe after three years, two years, and one year, respectively. The sanctioning power corresponds to the mayor, in accordance with article 21.1.n) of Law 7/1985, following the initiation of the proceedings and subject to Law 40/2015 and Law 39/2015.
Noise, public roads, and waste
The ordinance sets specific limits regarding rest: between 00:00 and 8:00 hours, singing or speaking in an excessively loud tone in homes, stairwells, or community spaces is not permitted, nor are domestic noises that exceed 30 dB at the point of reception. Establishments with musical ambiance—those whose interior sound level exceeds 90 dB—must have at least one person in charge of security and order.
It is also prohibited to light fires outside of designated areas, urinate or defecate on public roads, feed stray animals without authorization, fail to pick up pet waste, place clotheslines visible from the street, and graffiti walls or facades without permission. Regarding waste, disposal in containers is only permitted between 19:00 and 6:00 hours, and bulky items and waste must be taken to the recycling center (punto limpio). The occupation of public roads with terraces, non-sedentary sales, kiosks, or signs is subject to a prior license or concession.
Entry into force and appeal
The final provision refers to articles 65.2 and 70.2 of Law 7/1985 to establish validity fifteen days after full publication in the provincial bulletin. An administrative-law appeal (recurso contencioso-administrativo) may be filed against the agreement before the Administrative Chamber of the High Court of Justice of Cáceres within two months from the day following publication, according to article 46 of Law 29/1998. Monitoring compliance corresponds to the city council, which will report complaints to the Civil Guard, and the use of video cameras on public roads is referred to Organic Law 4/1997.
The regulation affects both residents and visitors of Aliseda and turns everyday behaviors—previously without specific local regulation, from alcohol consumption on the street to garbage disposal times—into sanctionable infractions, with a very serious tier that can reach 3,000 euros.
