Alcalá la Real delegates the mayoralty to two deputies during August

The City Council of Alcalá la Real (Jaén) will be governed during the second half of August by its two deputy mayors, who will successively assume all the functions of the Mayor’s Office. The mayor, Antonio Marino Aguilera Peñalver, will be absent on vacation from Sunday 16 to Monday 31 August, both inclusive, according to Decree number 3635, of 11 August 2026, published in the Official Gazette of the Province of Jaén number 156, of 13 August 2026 (p. 12586; reference 2026/3918).

The resolution is issued in accordance with Articles 21.3 and 23.3 of Law 7/1985, of 2 April, regulating the Bases of Local Government, and with Articles 44.1 and 2 and 47.1 of the Regulations on the Organization, Operation and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of 28 November. The edict, signed by the mayor in Alcalá la Real on 11 August 2026, recalls that it is the duty of the deputy mayors to substitute for the mayor in all his/her functions, in the order of their appointment, in cases of absence, illness or impediment, as well as to perform the mayor’s functions in the event of a vacancy. The declared objective is not to disrupt the normal functioning of municipal administrative activity during the summer period.

Who will govern and when

The decree distributes the mandate in two consecutive shifts covering the entire period of the mayor’s absence:

  • María Mercedes Flores Sánchez, first deputy mayor, will assume the Mayor’s Office from Sunday 16 to Friday 21 August 2026, both inclusive.
  • Jesús Aguilar López, second deputy mayor, will assume it from Saturday 22 to Monday 31 August 2026, both inclusive.

Scope of the delegation

The delegation includes the powers of direction and management, as well as the power to resolve the appropriate administrative procedures by adopting administrative acts affecting third parties. The delegates must subsequently report to the mayor on the management carried out and the provisions adopted, and prior reporting for those decisions of significance, in accordance with Article 115 of the aforementioned Regulations.

For its effectiveness, the delegation requires acceptance by the delegated body, which shall be deemed tacitly granted if no express statement of non-acceptance is submitted to the Mayor’s Office within three working days from notification.

Procedure and entry into force

The resolution shall be notified to the council members and its content shall be reported to the Plenary of the Corporation at the first ordinary session held. The delegation takes effect from the day following the date of the decree, without prejudice to its mandatory publication in the Official Bulletin of the Province, carried out in accordance with article 44.2 of the Regulation on Organization, Functioning and Legal Regime of Local Entities.

With this measure, the City Council of Alcalá la Real guarantees the continuity of municipal activity during the mayor’s summer absence: residents, businesses and entities that maintain open procedures with the Consistory will not see their processing interrupted in the second fortnight of August, a period in which command will fall rotationally on the two deputy mayors, who must account for their management to the mayor upon his return.
