Albacete consolida un suplemento de crédito de 1,07 millones para amortizar préstamos

The Albacete City Council has consolidated a credit supplement of 1,071,919.94 euros charged to the 2025 treasury surplus, once the public exhibition period elapsed without any claims being filed. The agreement is thus definitively approved and is published summarized by chapters in the Official Gazette of the Province of Albacete number 123, dated October 21, 2026, in the third section (Local Administration), page 18, with the official reference 26.192.

The announcement is supported by article 177.2 of the Royal Legislative Decree 2/2004, of March 5, which approves the revised text of the Law regulating Local Treasuries, which refers to article 169 of the same legal text. The modification affects the 2026 budget and is fully financed by the Treasury surplus for general expenses resulting from the 2025 fiscal year settlement.

The process began in the municipal Plenary, which initially approved the operation in the session held on August 27, 2026. That initial agreement was published in the Official Gazette of the Province of Albacete number 107, dated September 14, 2026, page 9, with reference 23.074, opening a period of fifteen business days for examination and allegations before the Plenary.

A supplement to amortize BBVA loans

The destination of the credit is neither new current expenditure nor investment, but the reduction of financial liabilities. The initial approval identified the budgetary application 0202.01100.9130050, named “amortization of BBVA loans,” as the concept receiving the supplement of 1,071,919.94 euros.

The summary by chapters now being published confirms this technical fit, with a single item on each side of the budget:

  • Income: chapter 8, Financial assets, 1,071,919.94 euros.
  • Expenses: chapter 9, Variation of financial liabilities, 1,071,919.94 euros.

The symmetry between both figures indicates that the operation does not alter the budgetary balance: the accumulated surplus is applied to repay already contracted bank debt, not to expand spending programs.

From initial to definitive approval without allegations

The procedure followed the ordinary process for credit modifications financed with liquid Treasury surplus. Following the initial publication, the file was made available to interested parties on the municipal electronic office, with access to the electronic file via request to the email address enabled by the council.

As no claims were filed during the public information period, the modification was automatically elevated to definitive, as provided for by local treasury regulations. The announcement of October 21 expressly records this circumstance and considers the administrative processing of the operation closed.

Contentious-administrative appeal against the agreement

The publication does not close the path for challenge. Pursuant to Article 171 of Royal Legislative Decree 2/2004, a contentious-administrative appeal may be filed directly against the final approval of the credit modification in the form and within the time limits established by the rules of that jurisdiction, the knowledge of which corresponds to the Contentious-Administrative Chamber of the High Court of Justice of Castilla-La Mancha, based in Albacete.

The announcement appears signed by the Mayor and bears the order number 26.192 in the pagination of the provincial bulletin, which on that date dedicates its third Section to announcements from the Local Administration.

The relevance of the operation for the residents of the capital is twofold. On one hand, the City Council waives the use of 1.07 million euros from the 2025 surplus for new services or investments and directs them toward amortizing loans from BBVA, which reduces the future financial burden but limits the available spending margin for this fiscal year. On the other, the publication in the official bulletin opens the period for any interested party to challenge an agreement that is already executive and that conditions the municipal accounts for 2026.
