Por FactBox Admin

The Agurain City Council has approved the establishment and provisional approval of the tax ordinance regulating the Tourist Stay Tax of Agurain, along with the provisional approval of the modification of thirteen municipal ordinances. The agreement was adopted in an extraordinary plenary session held on October 7, 2026, and is published in the Official Gazette of the Historical Territory of Álava (BOTHA) no. 118, dated October 14, 2026 (reference 2026-02886). The announcement is signed by the mayor, Raúl López de Uralde Baltasar.
Regulatory framework and scope of the tax
The processing is supported by Article 19 of the Foral Regulation governing Local Treasuries and within the framework established by Foral Regulation 13/2026, of June 10, which regulates the Tourist Stay Tax in Álava. The tax levies stays in tourist accommodation establishments and tourist rental homes, and designates the natural or legal person owning the operation of the establishment as the taxpayer’s substitute.
The file is now subject to public exhibition and hearing for a period of thirty days, starting from the day following the publication of the announcement in the BOTHA. During this period, interested parties may examine the file and submit any claims and suggestions they deem appropriate. If none are submitted, the agreement will be considered definitively approved without the need for a new pronouncement by the plenary.
Thirteen revised tax ordinances
Along with the new tax, the plenary provisionally approved the modification of the following municipal ordinances:
- Tax ordinance regulating the Property Tax.
- Tax ordinance regulating the Vehicle Tax.
- Tax ordinance regulating the Construction, Installations and Works Tax.
- Sections a) and h) of the ordinance on fees for the private use or special exploitation of the municipal public domain.
- Sections a), c), d), e) and f) of the ordinance on fees for the provision of public services and the performance of administrative activities.
- Sections 9.1) and 9.2 of the ordinance on public prices for the provision of services and the performance of activities.
- Tax ordinance for the jolastoki service and morning classroom fee.
- Ordinance on fees for the exploitation of forest products for neighborhood bonfires.
- Ordinance on public price tariffs for the provision of children and youth services.
- Ordinance for the use of facilities for seasonal workers of the Agurain City Council.
- Ordinance on livestock exploitation in the municipal-owned forests 610 “Sotos y Vargas” and 611 “Udala”.
- Municipal ordinance regulating driveways.
- Ordinance for the management and provision of the fixed clean point or garbigune service of Agurain.
One more municipality on the Álava list
Agurain thus joins the list of Álava city councils that are processing this tax throughout 2026, including Lantarón, Elciego, Vitoria-Gasteiz, Kripan, Legutio, Lanciego, Leza, Navaridas, Labastida, Lapuebla de Labarca, Villabuena de Álava and Samaniego, whose files have also been published in the BOTHA.
The relevance of the decision is twofold: it affects the hotel and accommodation establishments of the municipality, which will act as taxpayer substitutes and self-assess the tax, and the visitors staying overnight in Agurain, who must pay it. The thirty-day period opened with this publication is the last opportunity for residents, companies, and groups to submit allegations before the ordinance is definitively approved.
