Aguaviva unifies licenses, ICIO, and waste in new urban ordinance

The Plenary of the Aguaviva City Council, in an ordinary session on July 22, 2026, provisionally approved the modification of the Fiscal Ordinance Regulating urban activities, by a majority of five votes from the seven members of the Corporation. The agreement is published in the Official Gazette of the Province of Teruel number 165, dated August 31, 2026, under reference No. 2026-2540, and is subject to public consultation for thirty business days.

The new regulation gathers in a single text the regulation of municipal intervention in urban actions, the management of the Tax on Constructions, Installations and Works (ICIO), the management of construction and demolition waste, and the private use or special exploitation of the public domain for the purpose of executing works. The stated objective is to simplify administrative processing, adapt municipal regulations to current legislation, and provide greater legal certainty to the City Council’s actions.

A single regime of enabling titles

The ordinance distinguishes between two paths of municipal intervention. New construction works, extensions, renovations affecting the structure or volume, demolitions, and earthworks will require an urban planning license. In contrast, conservation and maintenance works, interior renovations that do not alter the structure, the replacement of finishes, and minor works that do not require a technical project may be processed via a responsible declaration.

• The responsible declaration enables the start of works from the day of its submission, without prejudice to the municipal powers of verification, inspection, and control.
• The inaccuracy or falsehood of essential data will produce the effects provided for in urban planning legislation.
• The City Council may verify the truthfulness of the declared information at any time.

ICIO at 2% and fee for occupation of the public domain

The ICIO will be required throughout the municipal district and will be governed by a self-assessment regime, which must be submitted and paid prior to the granting of the license or together with the responsible declaration. The tax rate is fixed at 2% of the taxable base, with a minimum quota of 10 euros.

• The taxable base will be the real and effective cost of the work, taking the material execution budget as the initial base.
• Upon completion of the works, the City Council may verify the real cost and perform the final settlement.
• No bonuses are established for the quota, without prejudice to those that may be applicable by law.

The public domain occupancy fee for construction works is set at 1 euro per square meter per month during execution, and 2 euros when the occupancy is maintained once the authorized period has expired, with a minimum fee of 10 euros.

Waste Management Guarantee

All works subject to a license or responsible declaration must comply with the obligations regarding construction and demolition waste, with the promoter being responsible for its correct management. For works with a waste management study, a guarantee must be established prior to the granting of the license.

• Amount of 12 euros per ton of waste provided for in the study.
• Minimum of 120 euros and maximum equivalent to 4% of the material execution budget.
• Once the works are completed, the guarantee will be returned upon accreditation of correct management; otherwise, the City Council may execute it in whole or in part.

Processing and Entry into Force

The file, initiated by the Mayor’s Office on July 20, 2026, included a legal report, a report from the Comptroller’s Office on its economic-financial impact, and an opinion from the Treasury Information Commission. The agreement shall be open to the public for thirty business days from its publication in the bulletin, and may be examined at the municipal offices and on the electronic headquarters www.aguaviva.es. If no claims are filed, it will be considered definitively approved, and the ordinance will enter into force once published in full in the Official Gazette of the Province of Teruel and after the period set forth in article 70.2 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime.

The new ordinance affects all works carried out in the municipality, from small renovations to large constructions, and unifies the procedures, taxes, and guarantees currently spread across several regulations into a single text. For residents, promoters, and sector companies, it provides a clearer and more predictable framework, with a moderate ICIO (Construction Tax) and a waste regime that reinforces the environmental protection of the municipal district.
