Acebo seeks permanent justice of the peace with a fifteen-day deadline
Por FactBox Admin

The Acebo City Council has opened a fifteen-business-day window for interested parties to submit their candidacy for the position of titular justice of the peace for the municipality, a designation that falls to the corporation’s Plenary. The edict is signed by the mayor-president, Julián Puerto Rodríguez, and is published in the Official Gazette of the Province of Cáceres no. 0210, corresponding to Tuesday, November 3, 2026 (CVE: BOP-2026-5116).
The Plenary elects and the Governing Chamber appoints
The City Council acts under the protection of articles 101 and 102 of Organic Law 6/1985, of July 1, of the Judiciary, and articles 4 and 5.1 of Regulation 3/1995, of June 6, of the Justices of the Peace, regulations that attribute to the municipal Plenary the election of the persons who are to carry out proximity justice in municipalities where no court of first instance exists.
The call published this Tuesday is the first link in the procedure: the City Council collects applications and, once the person is elected by the Plenary, the proposal is submitted to the competent body for the effective appointment. The process is completed with the publication of the appointment in the provincial gazette itself and the assumption of office.
As an immediate reference for the process, the Governing Chamber of the High Court of Justice of Extremadura agreed on September 21, 2026, to the appointment of the titular justice of the peace of Montánchez, Josué Antonio Solís Trejo, in an edict published in the BOP of Cáceres on October 2, 2026 (CVE: BOP-2026-4609), which reminds that the assumption of office must take place within twenty calendar days following the publication, after taking an oath or promise before the judge of first instance and instruction of the judicial district.
How and where to submit the application
Persons who meet the legal requirements must address their written application to the Mayor’s Office within the period of fifteen business days. The count begins the day after the publication of the edict, which places the closing of the period around November 24, 2026, without prejudice to any applicable holidays.
The City Council will inform those who request it of the precise conditions to hold the office and the causes of incapacity or incompatibility that prevent its exercise. The required documentation is as follows:
- Certified photocopy of the D.N.I. (National ID)
- Criminal record certificate
- Medical certification of not suffering from any disease that incapacitates the exercise of the office
- Sworn statement of not being subject to any cause of incapacity or incompatibility
- Sworn statement of current profession
Exception for those already holding the office
The edict provides an exception for cases of continuity. If the candidacies correspond to those already acting as a titular or substitute justice of the peace, it is sufficient to submit a request to the City Council, without the need to provide the aforementioned block of documentation.
For this purpose, the City Council relies on Article 28.2 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, which exempts the submission of documents that are already in the possession of the acting administration or have been prepared by it.
The edict concludes with the customary publicity formula —“Which is made public for general knowledge”— and is dated in Acebo on October 23, 2026, bearing the signature of the mayor-president under the heading Mayor-President.
A key position in rural Spain
The call for applications affects a small municipality in the north of the province of Cáceres, where the justice of the peace assumes functions of civil registry, summons, and conciliation that would otherwise force residents to travel to the judicial district. The renewal of the holder guarantees the continuity of this proximity service and prevents a vacancy in a body that organically depends on the High Court of Justice of Extremadura but whose proposal arises from the vote of the municipal Plenary.
Furthermore, the publication of the edict opens the window for community participation: any person registered in Acebo who meets the legal requirements may apply for the position within the fixed deadline, with the documentation submitted to the Mayor’s Office.
