Aarhus court declares Byens Bagel Nørregade bankrupt with no funds for creditors

Retten i Aarhus declared Byens Bagel Nørregade ApS bankrupt by decree on 19 October 2026, with no assets in the estate beyond what is needed to cover the costs of the proceedings. The ruling, docketed as SKS 41-20568/2026, was published in Statstidende on 21 October 2026 under reference S19102026-250. Creditors now have four weeks from that publication to register their claims with the appointed trustee.

The decree follows a bankruptcy petition received on 7 October 2026 against the company, registered as CVR 45281434 and operating from Nørregade 30, 8000 Århus C. At the time of the ruling the company was already under compulsory dissolution (tvangsopløsning), meaning the bankruptcy was opened on a business that had been placed in winding-up proceedings before the court acted. Advokat Christian Jul Madsen, of Kalkværksvej 16, 25., 8000 Århus C, was appointed trustee (kurator) for the estate.

The announcement is a bankruptcy decree (dekret) carried in Statstidende’s bankruptcy-estates section, the official channel through which the Danish courts publish insolvency rulings to creditors and the public. The decisive figure in the notice is the absence of any surplus: the estate is expected to be closed under konkurslovens § 143, the provision used when assets do not cover the costs of administration. For unsecured creditors, that means the proceedings are expected to yield no dividend.

Deadlines set for creditors

  • Claims must be filed with the trustee within four weeks of the 21 October 2026 publication, calculated as at 19 October 2026, the date of the bankruptcy decree.
  • Each filing should be accompanied by documentation of the claim.
  • Claims already submitted to the liquidator during the earlier compulsory liquidation are taken into account without a new filing, but any interest accrued up to the bankruptcy date must still be registered.
  • A request for the election of a trustee or for the appointment of a creditors’ committee must be submitted in writing to the skifteret within three weeks of publication.

Closing hearing on 26 November

The final court hearing (afsluttende skiftesamling) will be held in Skifteretten i Aarhus, Vester Alle 12, 8000 Aarhus C, on 26 November 2026 at 09:00. The notice states that the estate is expected to be closed at that hearing, given that there are no funds beyond those consumed by costs.

The decree is dated 19 October 2026 and issued in the name of Retten i Aarhus, with the trustee and the court listed as the two contacts for the case. No meeting for the election of a trustee or a creditors’ committee has been scheduled in the notice itself; any creditor wanting one must request it in writing within the three-week window.

What the ruling means

For suppliers, landlords and other unsecured creditors of the Nørregade bakery, the practical consequence is that filing a claim preserves a formal position in the estate but is unlikely to produce a payout, since the notice already anticipates closure for lack of funds. The four-week deadline is the operative date: claims not registered with Christian Jul Madsen by that point risk being excluded from the estate’s records before the 26 November hearing.

The case also illustrates how quickly a company can move from compulsory dissolution into bankruptcy in the Danish system: the petition reached the court on 7 October, the decree followed twelve days later, and the entire estate is scheduled to be wound up within roughly five weeks of the ruling.
