Aalborg restaurant estate proposes 100 percent dividend to 95 creditors

The bankruptcy estate of the Aalborg restaurant company El Santo - Cantina Mexicana ApS has proposed a dividend of 100 percent to 95 claims, which would mean the creditors are repaid in full. The draft accounts and distribution are to be presented for confirmation at a closing probate hearing in Retten i Aalborg on 3 December 2026 at 13:00, according to a notice published in Statstidende on 30 October 2026 (reference S28102026-280).

The notice is signed by Retten i Aalborg on 28 October 2026 and appears under the heading Konkursboer – Regnskab og boafslutning, the bankruptcy-estate section of the official gazette. It names the debtor as El Santo - Cantina Mexicana ApS, CVR-nr. 43092073, with an address at Nytorv 27, 9000 Aalborg, and identifies the proceedings as Sagsnr. SKS 31-81/2026.

A dividend of 100 percent is the ceiling of what a bankruptcy estate can distribute: every admitted claim is met at its nominal value rather than at the fraction of a krone that normally results when a failed business is wound up. The notice does not state the total value of the estate or list individual creditors. The operative figures it does give are the distribution rate and the number of claims covered, 95.

Hearing details at the probate court

The closing session (afsluttende skiftesamling) is summoned on the following terms:

  • Date and time: Thursday 3 December 2026 at 13:00.
  • Venue: Retten i Aalborg, meeting room 5, first floor, waiting room on the first floor, 9000 Aalborg.
  • Purpose: treatment and possible confirmation (stadfæstelse) of the draft accounts and distribution.
  • Estate: El Santo - Cantina Mexicana ApS, CVR-nr. 43092073, Sagsnr. SKS 31-81/2026.
  • Dividend: 100 percent to 95 claims.

The hearing is the point at which the court may adopt the proposal as it stands; the notice describes confirmation as the step that makes the distribution operative.

Inspection of the draft accounts

The draft accounts and distribution proposal lie for inspection at the probate court (skifteretten) in Aalborg, the notice states, without giving a separate deadline for inspection. Any creditor wishing to be heard on the figures is expected to do so in connection with the session.

Payment is to be made four weeks after the accounts are confirmed, unless an appeal (anke) has been lodged before that date. The notice does not set out the appeal route or the appeal deadline beyond that conditional reference.

Claims notified late are excluded

A separate rule in the notice limits the class of creditors who can benefit from the full recovery:

  • Claims and other demands that are notified only after the accounts have been confirmed will not be taken into consideration.
  • Distribution follows four weeks after confirmation, provided no appeal has been lodged in the meantime.

In practice, the confirmation of the accounts closes the estate’s list of claims. Creditors who have not had a demand registered by that point lose their share of the 100 percent distribution, which is the central deadline for anyone with an outstanding invoice from the restaurant.

A rare full recovery

Full repayment is the outcome creditors of a closed restaurant rarely see, and the notice places it in the ordinary machinery of estate administration: a draft, an inspection, a summoned session, a confirmation and a payout date. For the 95 claims listed against El Santo - Cantina Mexicana ApS, the practical consequence is that the case is heading towards settlement rather than towards a partial dividend, and the only open question is whether the court confirms the accounts at the 3 December session.
