The Xunta declares the AFAGA Alzheimer's Foundation to be of Galician interest

The Department of Social Policy and Equality has declared the AFAGA Foundation to be of Galician interest and ordered its registration in the Registry of Foundations of Galician Interest. The decision, signed by the technical general secretary María Francisca Gómez Santos on September 11, 2026, is published in the Official Gazette of Galicia (DOG) no. 182, of September 24, 2026, in section III, Other provisions, with the reference CVE-DOG: dnrdc6m5-vf84-xh01-xzp0-lo0cmez73md1.

The declaration occurs after the foundation submitted the request for classification, declaration of Galician interest, and registry entry on December 15, 2025. The file was processed under Law 12/2006, of December 1, on foundations of Galician interest, and Decrees 14/2009 and 15/2009, of January 21, which approve the Regulation of foundations of Galician interest and that of the Registry. The competence corresponds to the department by virtue of article 7.2 of Decree 15/2009 in relation to Decree 139/2024, of May 20, on the organic structure of the department.

The resolution supports the decision based on article 34 of the Spanish Constitution, which recognizes the right to establish foundations for purposes of general interest, and article 27.26 of the Statute of Autonomy of Galicia, which attributes exclusive competence to the Autonomous Community over the regime of foundations of Galician interest. Before resolving, the commission composed of the technical general secretaries of all departments, meeting on July 28, 2026, submitted to the counselor of Presidency, Justice and Sports the proposal for classification as being of social interest.

Constitution in Vigo and foundational object

The AFAGA Foundation was constituted by the Association of Relatives of Patients with Alzheimer’s and Other Dementias of Galicia (AFAGA), represented by its president Juan Carlos Rodríguez Bernárdez, in a public deed granted in Vigo on December 11, 2025, before the notary Miguel Lucas Sánchez, under number 3,556 of his protocol. The deed was amended by another granted in the same city and before the same notary on June 23, 2026, under number 1,775 of the protocol.

According to article 6 of its statutes, the foundation’s object is to contribute to innovation in the approach and care of people affected by Alzheimer’s disease or other forms of dementia. The foundational rule understands “affected” as the binomial formed by the person with the disease and the person who assumes care within the family sphere, without prejudice to extending its care to Galician society as a whole.

Initial Board and statutes

The initial board of the foundation is composed of:

• Juan Carlos Rodríguez Bernárdez, as president.
• Olga Visitación Milla Castro, as vice president.
• Remigio Rodríguez Pérez, as secretary.
• María Carmen Álvarez Yrago, as treasurer.

Our statutes state the name and nature, the object and activities, the address and scope of action, the rules for the application of resources to the foundational purposes and for the determination of the beneficiaries, the composition of the board of trustees, the rules for the appointment and substitution of members, the causes for termination, their powers, and the method of deliberation and adoption of agreements.

Classification, protectorate and obligations

By means of the Order of the Ministry of Presidency, Justice and Sports of August 21, 2026, the foundation was classified as being of social interest and attached to the Ministry of Social Policy and Equality for the purposes of exercising the functions of the protectorate. The resolution orders the registration in the Registry of Foundations of Galician Interest, in the section of the Ministry of Social Policy and Equality.

The foundation is subject to Law 12/2006, Decrees 14/2009 and 15/2009, and other applicable regulations, which impose obligations such as providing sufficient publicity of its object and activities, acting as a non-profit in the provision of its services, and presenting the accounting documentation and the action plan annually before the protectorate.

Administrative appeal (Recurso de alzada)

Against the resolution, which does not end the administrative route, an administrative appeal (recurso de alzada) may be filed before the Minister of Social Policy and Equality within one month from the day following its publication, according to articles 121 and 122 of Law 39/2015, of October 1, on the common administrative procedure of public administrations.

The registration places the AFAGA Foundation under the regime of foundations of Galician interest and under the protectorate of the Xunta de Galicia, which obliges it to render accounts annually and allows it to operate within a recognized legal framework to develop care programs for people with Alzheimer’s and their families in Galicia.
