A Peroxa aproba unha taxa forestal con fianzas de ata 6.000 euros

The City Council of Peroxa published in the Official Gazette of the Province of Ourense on October 7, 2026, the final approval of the ordinance regulating the special common use of the local public domain for timber extraction activities in the mountains and forest areas of the municipality. The regulation creates a fee for the special use of municipal-owned roads and establishes bonds of up to 6,000 euros and sanctions between 750 and 20,000 euros. The text appears in section IV, Local Entities, with the official edict reference 352670 and registration number R. 2.269.

The Municipal Plenary, in the ordinary session of March 31, 2026, initially approved the ordinance. The text was exposed to the public via an announcement in the Official Gazette of the Province of Ourense no. 94, of May 21, 2026, for a period of thirty business days. As no objections were raised during that period, the regulation is elevated to final and published for general knowledge.

The ordinance is based on the powers of articles 133.2 and 142 of the Spanish Constitution, article 106 of Law 7/1985, of April 2, regulating the bases of the local regime, and articles 9.11 and 15 to 27 of the revised text of the Law regulating local treasuries, approved by Royal Legislative Decree 2/2004, of March 5.

What is taxed and who pays

The taxable event is the special use of the local public domain for the purposes of depositing, skidding, and transporting timber resulting from forest exploitation. The passive subjects, as taxpayers, are the natural and legal persons and the entities referred to in article 35.4 of Law 58/2003, of December 17, General Tax Law, who request the mandatory authorizations.

The logging company is directly responsible for all damages and losses to persons and property caused by the deposition, extraction, and transport of the timber, and is obliged to repair them. The obligation is also enforceable for the acts of third parties who intervene in the operations on behalf of, with the consent or acquiescence of, the company.

Prior communication and guarantees

The felling must be communicated to the council with a minimum notice of fifteen business days, without prejudice to other sectoral authorizations. The communication must include:

  • Identification of the mountain owner and the logger, with a representative in the case of a legal person.
  • Species of wood and approximate tonnage to be extracted.
  • Identification on the cadastre map or the SIXPAC of the affected mountain, cadastral reference, deposition site, and transport routes.
  • Planned start and end date of the works.
  • Proof of the request for the felling permit before the Department competent in forestry matters.
  • Proof of the guarantee deposit or bond.

The bonds in favor of the council are fixed in three tiers:

  • Vehicles with a maximum authorized weight of less than 16 tonnes: 2,000 euros, or civil liability insurance of at least 25,000 euros.
  • Vehicles of 16 tonnes or more: 3,000 euros, or insurance of at least 50,000 euros.
  • Annual global guarantee for companies with habitual extractive activity: 6,000 euros, or insurance of at least 75,000 euros.

Sanctioning regime

Infractions are classified as slight, serious, and very serious, and will be sanctioned with a variable fine:

  • Slight infraction: from 750 to 1,000 euros.
  • Serious infraction: from 1,001 to 6,000 euros.
  • Very serious infraction: from 6,001 to 20,000 euros.

Serious conducts include the deterioration of municipal roads and paths, failure to repair damages or clean forest remains within fifteen business days from the completion of the works, and carrying out the extraction without depositing the corresponding guarantee. Very serious offenses include relevant deterioration that prevents the circulation of vehicles and the use of roads as timber storage with risk to users. The regime is governed by Law 39/2015 and Law 40/2015, of October 1, and by title XI of Law 7/1985.

The regulation directly affects logging companies operating in the municipality and forest owners, who must identify the company in charge of the cutting and be responsible for the conditions in which the roads are left. The text was signed by the mayor of Peroxa with the digital signature date in the margin.
