Aínsa-Sobrarbe eleva a definitivo el régimen sancionador de la tasa del agua

The Aínsa-Sobrarbe City Council has definitively approved the modification of Fiscal Ordinance No. 14, which regulates the fee for the provision of the drinking water supply service, after no claims were filed during the public exhibition period. The full agreement is published in the Official Gazette of the Province of Huesca number 205, dated October 26, 2026, in the Local Administration section, with the official reference BOPH-2026-205001. The regulation is elevated to definitive status in compliance with article 17.4 of the Recast Text of the Law Regulating Local Treasuries, approved by Royal Legislative Decree 2/2004, of March 5.

The proceedings began with the Ordinary Plenary held on September 2, 2026, in which the council provisionally approved the modification by a sufficient legal majority. The announcement of the initial approval was inserted in the Official Gazette of the Province of Huesca number 170, dated September 7, 2026, opening a thirty-day public information period during which the file could be examined both at the municipal offices and on the city council’s electronic headquarters. As no allegations were formalized, the provisional agreement has been automatically elevated to definitive.

Filling swimming pools, a very serious infringement

The text being made public modifies article 12 of the ordinance, dedicated to infringements and sanctions. The main novelty is that filling swimming pools with water from the public supply network within the municipal district of Aínsa-Sobrarbe is classified as a very serious infringement.

To prove these cases, the Aínsa-Sobrarbe City Council may carry out verification reports through the Municipal Technical Services. The financial penalty provided for this conduct is between 3,001 and 6,000 euros, once graded according to the applicable criteria.

Staggered fines and drought decrees

The ordinance also establishes that, in cases of drought, water supply shortages, or other circumstances, the guidelines set by the city council via Municipal Decree must be followed. Failure to comply with these orders will result in a minor, serious, or very serious infringement, graded by the Municipal Technical Services with a corresponding report.

The amount of the fines is staggered into three tiers:

  • Minor infringements: between 1 and 1,000 euros.
  • Serious infringements: between 1,001 and 3,000 euros.
  • Very serious infringements: between 3,001 and 6,000 euros.

Regarding everything related to the classification of tax infringements and the determination of sanctions, the regime regulated in the General Tax Law and in the provisions that complement and develop it shall apply.

Two months to appeal before the High Court of Aragon

An administrative appeal may be filed against the agreement before the Administrative Chamber of the High Court of Justice of Aragon, based in Zaragoza, within a period of two months starting from the day following the publication of the announcement. This is established in Article 19 of the Recast Text of the Law Regulating Local Treasuries and Article 46 of Law 29/1998, of July 13, regulating Administrative Jurisdiction.

The announcement appears signed in Aínsa on October 21, 2026, by the Mayor-President, Enrique Pueyo García, and is inserted on page 5 of the provincial bulletin, within the announcements of the province’s city councils.

The entry into force of this modification directly affects the residents of the municipality, who from now on face a more explicit sanctioning regime regarding the use of public network water, especially during periods of scarcity. The full text of the ordinance is published in the provincial bulletin for general knowledge, so that any subscriber may consult the sanctionable cases and the applicable amounts before the next irrigation and pool-filling season.
