Zorita emplaza a los interesados en el procedimiento abreviado 149/2026

The Zorita City Council has summoned potential interested parties to Abbreviated Procedure No. 149/2026, currently pending before the Contentious-Administrative Section of the Court of First Instance of Cáceres, Plaza No. 2, regarding municipal inactivity concerning the breakdown of the water supply network on Calle Puerto. The announcement, signed by the mayor-president Jerónimo Ruíz Rodríguez, is published in the Official Gazette of the Province of Cáceres No. 0199, dated October 16, 2026, with official reference BOP-2026-4865. Affected parties have nine days to appear.

The procedure arises from the contentious-administrative appeal filed against the dismissal by administrative silence of the prior claim for inactivity against the City Council, formulated under Article 29.1 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction. The object of the litigation is the breakdown of the municipal water supply network on Calle Puerto in Zorita, and the file is processed under N.I.G. 10037 45 3 2026 0000248.

By Mayoral Resolution of October 6, 2026, it was agreed to remit to the aforementioned judicial body administrative file No. 1020/2025, from which the appeal arises; this remittance was carried out via the administrative file uploader (INSIDE) on October 7, 2026.

Who may appear and under what conditions

In accordance with Article 49.1 of Law 29/1998, the announcement summons any persons, other than those already personally notified, who hold legitimate rights or interests that could be affected by the granting of the appellant’s claims, so that they may appear and intervene as defendants if they deem it appropriate for their legal rights.

  • Deadline: nine days starting from the day following the publication of the announcement in the Official Gazette of the Province of Cáceres.
  • Body before which to appear: Contentious-Administrative Section of the Court of First Instance of Cáceres, Plaza No. 2.
  • Procedural position: defendants.
  • Representation and defense: as provided for in Article 23 of Law 29/1998.

Effects of appearing after the deadline

Article 50.3 of Law 29/1998 establishes that anyone who appears after the indicated deadline shall be considered a party without the course of the procedure having to be rolled back or interrupted. If they do not appear in a timely manner, the procedure will continue through its stages without any further notification being required.

Publication and City Council background

The announcement is published in the Official Gazette of the Province of Cáceres and on the notice board of the electronic headquarters of the Zorita City Council (https://zorita.sedelectronica.es). The same council previously published in bulletin no. 0189, dated October 2, 2026 (BOP-2026-4601), the collective notification and collection edict for the third four-month period of 2025 for water, garbage, and sewage, approved by Plenary agreement no. PLN/2026/4 of September 24, 2026, with a voluntary payment period between September 25 and November 25, 2026.

The summons opens the way for residents and holders of rights or legitimate interests other than those already notified to join the proceedings and defend their position before the contentious-administrative courts. The deadline is short—nine days from publication—and its expiration without appearance does not halt the litigation; therefore, anyone who considers themselves affected by the breakdown on Calle Puerto and by the municipal action must decide quickly whether to appear.
