Xinzo appoints a temporary instructor for traffic files

The City Council of Xinzo de Limia has appointed a temporary instructor for sanctioning proceedings regarding traffic matters, due to the absence of the chief inspector of the Local Police. The decision was adopted by Mayoral Decree of 08/26/2026 and published in the Official Gazette of the Province of Ourense on September 1, 2026, in the Local Entities section.

The appointment falls to local police officer Manuel José Gándara Rodríguez, who will temporarily assume the instruction of these proceedings from 08/26/2026 until the reinstatement of inspector José Manuel Estévez Franco, the permanent instructor.

An appointment covering a temporary absence

The decree is based on the appointment of José Manuel Estévez Franco as chief inspector of the Local Police of Xinzo de Limia, agreed upon by Mayoral Decree of 04/04/2024 under Article 27 of Law 4/2007, of April 20, on the coordination of local police in Galicia. That decree also assigned him the instruction of traffic sanctioning proceedings.

Given the temporary absence of the instructor, the Mayor’s Office resolved that Manuel José Gándara Rodríguez assume this function provisionally, thus guaranteeing continuity in the processing of sanctioning procedures.

Communication and procedures

The decree provides for the communication of the appointment to the organizations and companies involved in the management of the proceedings:

  • To the official appointed as temporary instructor, Manuel José Gándara Rodríguez.
  • To inspector José Manuel Estévez Franco.
  • To the companies Vialine Gestion SLU and ITM Instalaciones y Mantenimiento de Comuniciones SLU.
  • To the Councilor for Traffic and the municipal departments of Treasury and Personnel.

Furthermore, the resolution must be reported in the next session of the municipal Plenary.

Appeals against the resolution

The resolution exhausts the administrative route. Alternatively, the following may be filed against it:

  • An optional appeal for reversal (recurso de reposición) before the mayor, within one month from notification, in accordance with articles 123 and 124 of Law 39/2015, of October 1, on the common administrative procedure.
  • A contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Ourense, within two months, in accordance with article 46 of Law 29/1998, of July 13, on contentious-administrative jurisdiction.

The document, electronically signed by mayor Amador Díaz Penín, ensures that the processing of traffic fines and sanctions is not paralyzed during the absence of the chief inspector, a key issue for the operation of the police force and for citizens with ongoing proceedings.
