WOM must complete 90% of 5G by September 30

The Undersecretariat of Telecommunications (Subtel) rectified the public telecommunications service concession of WOM SpA through exempt decree No. 881, published in the Official Gazette No. 44,559 on Saturday, September 26, 2026, in Section II (Particular Norms), with official reference CVE 2876553. The act is based on the Public Deed of Settlement between WOM SpA and the Treasury of Chile, which obligates the concessionaire to complete ninety percent of the Five G Project by September 30, 2026. The resolution was issued in Santiago on August 24, 2026, and bears the signatures of the Minister of Transport and Telecommunications, Louis de Grange Concha, and the Undersecretary of Telecommunications, Romina Garrido Iglesias.

The regulatory framework invoked by Subtel includes Decree Law No. 1,762 of 1977, which created the agency; Law No. 18,168 of 1982, General Telecommunications Law; Supreme Decree No. 103 of 2008; Supreme Decree No. 19 of 2021 from the Ministry of Transport and Telecommunications, which granted the concession and its amendments; exempt resolution No. 265 of 2013, which establishes the Technical Standard for the use of the 700 MHz band; and resolution No. 36 of 2024 from the Comptroller General of the Republic, regarding the exemption from the toma de razón (legal review) process. The concessionaire’s request was submitted to Subtel under entry No. 107,535 on July 27, 2026.

What exempt decree No. 881 authorizes

The decree rectifies the concession of WOM SpA, RUT 78,921,690-8, domiciled at General Mackenna No. 1369, commune of Santiago, Metropolitan Region of Santiago, in the sense of authorizing the change of address of a base station:

Base Station AN10051, Antofagasta Region.
Old address: RUTA B-55 and RUTA B-241, Antofagasta.
New address: 550 meters southwest of the intersection of Ruta B-55 and Ruta B-247, approximately 52 kilometers northeast of Minera Escondida.
Geographic coordinates: south latitude 24° 04’ 31.14"; west longitude 68° 36’ 19.22".
Original authorizing act: supreme decree No. 19 of 2021.

The 90% milestone of the Five G Project

Recital c) of the decree reproduces numeral 1.1.3 of the Public Deed of Settlement between WOM SpA and the Treasury of Chile, signed on October 29, 2025, before the Interim Notary Public of the Fifth Notary Office of Santiago, Magdalena Sofía Latorre Larraín, which indicates that ninety percent of the Five G Project must be completed by September 30, 2026. Recital d) cites numeral 1.1.5 of the same deed, which prioritizes the resolution of concession modification requests submitted by the company.

Subtel states that the maximum terms and other technical characteristics not considered in the application shall remain unchanged, in accordance with the supreme decree that granted the concession and the provisions of the aforementioned Public Deed of Settlement.

The rectification is part of a package of ten exempt decrees referring to WOM SpA published in the same issue of the Official Gazette:

Obligations that remain

The act approved the application submitted by the concessionaire and ordered that the respective documentation be archived in the Undersecretariat of Telecommunications. Furthermore, it reiterates that it is the obligation of WOM SpA to be aware of and comply with the legal, regulatory, and technical provisions governing telecommunications, and establishes that the notification of the authorizing act will be sent from the inbox partes@subtel.gob.cl.

The milestone of September 30, 2026, is decisive for mobile telephony users: it determines whether WOM SpA’s 5G network reaches the coverage committed to the Treasury of Chile, in a context where Subtel is simultaneously processing a dozen modifications and rectifications of the same company’s concession.
