Villarcayo removes the official status of a property to exchange it with the State

The Plenary Session of the City Council of Villarcayo de Merindad de Castilla la Vieja initially approved, in its session on August 13, 2026, the alteration of the legal classification of the municipal property located at San Roque St. No. 42, to enable its subsequent exchange with the General State Administration. The agreement, adopted within the framework of File 45/2026, is published in the Official Gazette of the Province of Burgos number 164, dated August 31, 2026 (C.V.E.: BOPBUR-2026-03620).
The operation, titled “Liceo and Plot – Urban Center of Villarcayo,” seeks the reorganization of municipal services and the expansion of the judicial facilities of the Judicial District of Villarcayo. The municipal property would be exchanged for the state-owned building currently used as the judicial headquarters, located at Héroes del Alcázar Square No. 1.
A file processed since June
The initiation of the file was ordered by a Mayoral decree dated June 17, 2026, gathering the necessary documentation and reports to study the feasibility of the decommissioning and subsequent exchange. The file includes the legal report from the General Secretariat, which concludes the possibility of processing the alteration of the legal classification of the asset provided that its expediency and legality are proven.
The proposed resolution PR/2026/1593, dated August 5, 2026, served as the basis for the plenary agreement. The property is registered in the municipal inventory under number 0990332/00085/1.1.00033 and with cadastral reference 3645929VN5534N0001OL, as a public domain asset assigned to a public service.
From public domain to patrimonial asset
The resolution agrees to the change in the legal classification of the property, which changes from a public domain asset assigned to a public service to a patrimonial asset, due to reasons of expediency and public interest. The competence lies with the Plenary, which requires the favorable vote of an absolute majority of the legal number of members, following the opinion of the competent information commission.
The regulatory basis of the agreement is supported by:
- Article 8 of the Regulations on Assets of Local Entities, approved by Royal Decree 1372/1986, of June 13.
- Articles 22.2.l), 47.2.n) and 81 of Law 7/1985, of April 2, regulating the Bases of the Local Regime.
- The revised text of the legal provisions in force regarding the local regime, approved by Royal Legislative Decree 781/1986.
One month of public information
The file shall be subject to public consultation for a period of one month, via an announcement in the Official Gazette of the Province of Burgos, on the municipal notice board, and on the City Council’s electronic office, so that interested parties may examine it and submit allegations or claims. If no allegations are presented, the file will be submitted again to the Plenary for the final approval of the alteration.
Against the resolution, which concludes the administrative process, interested parties may file an optional appeal for reversal within one month or a contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Burgos within two months. The agreement, dated August 18, 2026, is signed by the mayor, Adrián Serna del Pozo.
The exchange will allow the municipality to transfer a heritage property to the State in exchange for the judicial headquarters, a move that strengthens the judicial services of the district and rationalizes municipal assets, with a direct impact on the services provided to the residents of the Las Merindades region.
