Villaobispo de Otero processes the repeal of its water ordinance

The Neighborhood Council of Villaobispo de Otero has provisionally approved the repeal of the current Ordinance on the supply of drinking water in that locality, understanding that the regulation classifies a consideration whose legal nature is that of a tax as a public price. The agreement was adopted in the session held on July 29, 2026, and is now published in the Official Gazette of the Province of León no. 179, of September 18, 2026, with the official reference BOP-LE-2026-179024. The announcement opens a public information period of 30 business days for any interested party to examine the file and submit claims.

Two legal reasons to nullify the regulation

The agreement of the Neighborhood Council is based on two reasons that the entity itself details in the announcement published on page 66 of the provincial gazette:

• The ordinance configures the consideration for the domestic drinking water supply service as a public price, when its legal nature is that of a tax.
• The regulation limits its scope of regulation to the water supply, without adapting to the delegation made by the City Council for the management and operation of domestic drinking water supply and sewerage services.

The first reason is one of legal classification: the current text treats the service charge as a price, a figure typical of services provided under private law or requested voluntarily, whereas domestic water supply is a mandatory reception service and its financing must be structured through a tax. The second reason is one of scope: the ordinance falls short regarding the mandate received from the City Council, which covers both supply and sewerage, meaning the current regulation does not cover the entire delegated scope.

Thirty business days to examine the file

The announcement subjects the agreement to public information for a period of 30 business days, counted from the day following the insertion of the announcement in the Official Gazette of the Province of León. During that period:

• Any natural or legal person may examine the file at the headquarters of the Neighborhood Council of Villaobispo de Otero.
• Interested parties may formulate the claims and suggestions they deem appropriate.
• If no claims have been submitted after the period has elapsed, the agreement will be considered definitively approved.

The announcement was signed in León on September 10, 2026, by the Village Mayor, Camino Isabel Álvarez Pérez, and appears in the summary of the gazette under the heading of the public information period for the provisional approval of the repeal of the current Ordinance on the supply of drinking water.

What this means for service subscribers

The repeal directly affects the water service subscribers of the town, as the regulation that until now governed the conditions of supply and the consideration paid becomes ineffective if the agreement is made final. The decision does not imply the interruption of the service, but rather the disappearance of the current regulatory coverage, which forces the Neighborhood Board to provide itself with an instrument adapted to the municipal delegation and the tax nature of the charge.

The processing also takes place within a context of revision of the fiscal and regulatory ordinances of services in the smaller local entities of the province, several of which appear in the same bulletin with public exhibition procedures for their budgets and general accounts.
