Vilalba summons those interested in the litigation over the work at Rúa Nova 10
Por FactBox Admin

The Vilalba City Council summons interested parties to appear in the contentious-administrative appeal abbreviated procedure no. 111/2026, which is being processed in the Contentious-Administrative Section of the Court of First Instance of Lugo, square number 2. The announcement, signed by the mayor Marta María Rouco Seoane on October 28, 2026, is published in the Official Gazette of the Province of Lugo no. 255, corresponding to Friday, November 6, 2026, with the official reference R. 3001. The object of the litigation is the declaration of inefficiency of a prior communication of work relating to a plot enclosure and a shed at Rúa Nova number 10.
The Council received the request for the administrative file and the judicial summons, which it processes under municipal file number 5129/2026. The publication of the summons responds to the mandate of article 49 of Law 29/1998, of July 13, regulating the contentious-administrative jurisdiction, and to the possibility that there may be interested third parties not identified in the file. The Council justifies the public procedure because the contested act may affect a plurality of people, including neighbors and owners of properties in the immediate vicinity of the plot.
Procedure data
The announcement precisely identifies the framework of the litigation:
- Judicial body: Contentious-Administrative Section of the Court of First Instance of Lugo, square number 2.
- Procedure: abbreviated number 111/2026, with NIG 27028 45 3 2026 0000208.
- Appellant: Montserrat Cora Castro.
- Contested act: resolution of the Mayor’s Office of the Vilalba City Council dated March 31, 2026, which dismisses the appeal for reversal filed against the declaration of inefficiency of the prior communication of work.
- Affected prior communication: number 221/2023, file 2794/2023, relating to plot enclosure and shed at Rúa Nova number 10.
- Municipal summons file: 5129/2026.
The administrative chain ending in court is, therefore, of two steps: first, the Mayor’s Office declares the prior communication submitted in 2023 inefficient and, subsequently, dismisses the reversal appeal against that decision through the resolution of March 31 of this year. Against this second act, which exhausts the administrative route, the appellant turned to the contentious-administrative jurisdiction.
Nine days to appear
The period for interested third parties to appear as defendants in the procedure is nine days. The count begins the day following the publication of the announcement in the Official Gazette of the Province of Lugo, that is, starting from November 7, 2026, and the appearance must be formalized before the Contentious-Administrative Section of the Court of First Instance of Lugo, square number 2.
Appearance allows those affected to defend their interests in the process, without the City Council acting as a party on their behalf. Edictal summons replaces personal notification precisely because the City Council does not have the complete identification of the persons with a legitimate interest in the matter, a common circumstance in urban planning procedures that affect adjacent plots or consolidated uses on a street.
A second judicial front on the same street
The litigation is not unrelated to the recent judicial activity of the Vilalba City Council in the same area. In the Official Gazette of the Province of Lugo no. 222, dated September 28, 2026, the City Council published another summons —reference R. 2565, file 4227/2026— in the abbreviated procedure no. 149/2026 (NIG 27028 45 3 2026 0000285), also with the same appellant, Montserrat Cora Castro.
In that case, the contested act was Decrees 2026-0422 (resolution PR/2026/652), which ended a legality restoration file for construction on a plot with cadastral reference 6946404PH0964N0001XU located on Rúa Nova. These are two distinct procedures, with their own numbers, acts, and deadlines, although they share the location and appellant, which places the surroundings of Rúa Nova at the center of a prolonged urban planning conflict.
Why it matters
The publication of the summons turns an administrative decision of individual scope into a matter open to all who prove a legitimate interest: owners of nearby plots, holders of easements, or any person who considers themselves affected by the land planning. Those who do not appear within nine days will be excluded from the process and will see their ability to challenge the result limited, while appearance allows for pleading and proposing evidence regarding the legality of the work originally communicated in 2023.
