Vilaboa empraza aos afectados polo inventario a comparecer en nove días

The City Council of Vilaboa summons potential interested parties in ordinary procedure 0000288/2026 to appear as defendants before the Contentious-Administrative Court, Court nº 2, of Pontevedra, within a period of nine business days. The decision was adopted by mayoral resolution, processed under file 2185/2026, and is published in the Official Gazette of the Province of Pontevedra (BOPPO) number 197, corresponding to Tuesday, October 13, 2026, in the Local Administration section, under the heading of Vilaboa.

The summons is in response to the official letter sent by the Court of First Instance, Contentious-Administrative Section, Court nº 2 of Pontevedra, with reference 2026-E-RC-3020 and dated October 6, communicating the filing of a contentious-administrative appeal. The resolution invokes the powers granted to the mayor by Article 21 of Law 7/1985, of April 2, regulating the bases of the local regime, and the corresponding provisions.

The announcement is inserted in the “Other documents, notifications and public information” section of the provincial gazette, the space reserved for official communications from city councils, and is electronically signed.

The appeal against the inventory of assets and rights

The appeal was filed by María Carmen Sotelino Dacosta against the agreement of the Plenary of June 1, 2026, which dismissed the appeal for reconsideration filed against the agreement of February 11, 2026, regarding the final approval of the Inventory of Assets and Rights of the City Council of Vilaboa, processed under file 954/2023.

The approval of the 2023 municipal inventory is, therefore, the administrative act under judicial review. The inventory of assets and rights is the instrument in which local entities list their patrimonial assets and the real or personal rights that correspond to them, meaning its challenge directly affects the delimitation of municipal heritage and the ownership of the included assets.

Three files sent to the court

Along with the communication of the summons, the resolution orders the transmission of the files related to the filed lawsuit to the judicial body:

  • 954/2023, approval of the 2023 municipal inventory.
  • 36/2022, investigation of the O Tombo path.
  • 1317/2024, access to public information.

Nine business days to appear

The appearance period is nine business days and is counted from the day following the publication of the announcement in the BOPPO. The resolution establishes the following actions:

  • Summon the potential interested parties in the cited files to appear as defendants before the judicial body in legal form.
  • Order the publication of the announcement for the general knowledge of all persons interested in the procedure.
  • Communicate to the court that there is no known existence of other contentious-administrative appeals in which cases of accumulation may occur.
  • Report the resolution to the Plenary of the Corporation at the first session it holds.

The document incorporates the secure verification code 19VKPT07ZVHC2AAR, which allows its integrity to be verified on the electronic office of the Provincial Council of Pontevedra, publisher of the bulletin.

Closing

For the affected neighbors and rights holders, the period of nine business days is the only opportunity to appear in the judicial procedure: whoever does not appear as a party will remain on the sidelines of a litigation that may redefine the inventory of assets and rights of the council and, with it, the ownership of roads and other assets included in file 954/2023.
