Por FactBox Admin

The City Council of Viana do Bolo has initiated investigation file 285/2026 to determine the ownership of a path located in the place of Tabazoa de Hedroso, within the municipal district of Viana do Bolo. The decision was adopted by Mayoral Decree issued on July 29, 2026, and published in the Official Gazette of the Province of Ourense on October 28, 2026, in section IV. Local Entities, with official reference R. 2.442. The announcement opens a one-month public information period so that affected persons may file allegations in defense of their rights.
The procedure and its starting point
The initiation is processed in accordance with article 49 of Royal Decree 1372/1986, of June 13, which approves the Regulation of assets of local entities. This precept regulates the investigation of the status of local assets when there are indications that a property or road may have a public character without being duly listed as such.
The file was opened following the request of Pilar Carballo Leal, via a written submission presented to the General Registry of the City Council on November 20, 2025, with entry registration number 2025-E-RC-2837, and in view of the municipal technical reports issued regarding the possible public ownership of the path.
The City Council specifies that the initiation aims to determine the ownership of the road, in view of the background and the incorporated technical documentation, and emphasizes that this act “does not constitute a definitive pronouncement” regarding its ownership.

Deadline, allegations, and publicity of the file

- Submit in writing any allegations they deem appropriate in defense of their rights.
- Provide the documents on which those allegations are based.
- Consult the file at the municipal offices, under the legally established terms.
Furthermore, the affected persons who are known and identifiable will be notified personally, in accordance with what was agreed upon by the Mayor’s Office. The announcement is published in the provincial bulletin and posted on the City Council’s notice board.
The document is dated in Viana do Bolo on October 9, 2026, and bears the signature of the mayor, Graciela Diéguez Rodríguez.
Why it matters
The resolution of this file could make public a road that currently has no definitive classification, which would affect both the neighborhood use of the path and the situation of the eighteen estates that border it. For the owners of the adjacent plots, the public information month is the only opportunity to present titles, documents, or allegations before the City Council resolves the issue of ownership.
