Verín expropriates Fontenova to create a public service space

The Verín City Council has given the initial green light to the expropriation of the land necessary to execute phases A and B of the large public endowment space in the Fontenova area. The decision was adopted by the mayor, Gerardo Seoane Fidalgo, through a decree of assumption of powers and initial approval of the two expropriation projects, published in the Official Gazette of the Province of Ourense on September 1, 2026.

The action is part of electronic administrative file 2648/2020, which includes the expropriation projects of the assets and rights necessary for the execution of the first phase A and the first phase B of the Special Plan for Infrastructure and Endowments for the creation of a large public endowment space in the Fontenova area.

Assumption of competence

The Mayor’s Office decided to assume, for this specific case, the competence that, through Mayor’s Resolution no. 2023/1106, published in the BOP of Ourense no. 154 on July 6, 2023, had been delegated to the Local Government Board. The delegation covered the approval of development planning instruments, urban management instruments, urbanization projects, and the resolution of expropriation files.

The decree justifies the assumption of powers due to the strategic relevance of the projected urban action and the need to promote the processing of the expropriation procedure in a coordinated, effective, and agile manner. The Mayor’s Office thus assumes the processing and resolution of the decisive administrative acts, including the act of approval of the expropriation project.

Legal basis and effects

The resolution is based on Article 10 of Law 40/2015, of October 1, on the legal regime of the public sector, and Article 21.3 of Law 7/1985, of April 2, regulating the bases of the local regime, as well as Articles 43, 44, 45, 114 to 118, 120, and 121 of the Regulation on the organization, functioning, and legal regime of local entities, approved by Royal Decree 2568/1986, of November 28.

The initial approval takes effect with the specific effects of the expropriation project in the joint appraisal procedure, without prejudice to its submission to public information and the individualized notification of appraisals, as provided for in Article 118 of Law 2/2016, of February 10, on Galician land, in relation to Articles 291 and following of Decree 143/2016, of September 22.

Processing and appeals

The resolution will be published in the official gazette, although it takes effect from the day of its signature, and will be notified to the persons interested in the procedure. The Local Government Board will also be informed for its knowledge.

• No appeal may be filed against the act of avocación, without prejudice to the possibility of challenging the administrative act issued in execution thereof.
• The decree is signed for purposes of public record and not legality by the interim secretary, in accordance with article 3.2 h) of RD 128/2018, of March 16.

The expropriation of Fontenova constitutes a key step in providing the town of Verín with a large public service space, a strategic action that directly affects the owners of the involved lands and will mark the urban development of the area in the coming years.
