Vegueta-Triana modifies its protection to execute the TSJC ruling

The Governing Board of the City of Las Palmas de Gran Canaria has initially approved, in an ordinary session held on July 30, 2026, the Minor Modification of the Special Protection Plan for “Vegueta-Triana” to execute the Judgment of November 7, 2024, by the High Court of Justice of the Canary Islands. The agreement has been submitted for public information via an announcement on August 9, 2026, published in the Official Gazette of the Canary Islands number 173, dated August 28, 2026.

The modification arises from the judgment issued in ordinary proceeding no. 157/2018 by the Administrative Litigation Chamber, 2nd Section of the TSJC, which altered the degree of protection assigned to the property located at calle Cano, 12, corresponding to File VT-053 of the Special Plan’s Protection Catalog. The instrument, formulated and promoted by the City Council itself, adapts the planning to the judicial ruling.

Suspension of urban planning licenses

The initial approval entails the automatic suspension of the granting of urban planning licenses within the territorial scope of the modification, in accordance with articles 99.1 and 86.2 of the Planning Regulations of the Canary Islands. The effects of the suspension will expire upon final approval and, in any case, after the lapse of two years from the initial approval.

  • The suspension area coincides with the physical delimitation of the cataloged plot, located at calle Cano, no. 2, Vegueta neighborhood.
  • Licenses may be processed for projects adapted to the regime in force at the time of the request, provided it has not been altered by the proposed determinations or that these are less restrictive.

Public information process

The file is submitted for public information for a period of one month, counted from the day following the publication of the announcement in the Official Gazette of the Canary Islands, in accordance with article 147.3 of Law 4/2017, of July 13, on Land and Protected Spaces of the Canary Islands. During this period, the documentation may be examined and allegations may be formulated.

  • The documentation can be consulted Monday to Friday, from 8:00 to 13:30 hours, at the Urban Planning Service (Planning and Urban Management Section), Plaza de la Constitución, no. 2 (former Emalsa Building).
  • It is also available on the municipal Urban Planning and Infrastructure portal, and an appointment can be requested by calling 928 44 63 63.
  • The file is likewise submitted, for one month, for consultation by the Public Administrations affected territorially or by reason of their competencies.

Nature of the agreement and appeals

The initial approval, being a procedural act, does not exhaust administrative remedies; therefore, no appeal may be filed against it, except for the exceptional cases set forth in Article 112 of Law 39/2015. An appeal for reversal (recurso de reposición) may be filed against the agreement to suspend licenses within one month before the same body, or it may be challenged directly before the Contentious-Administrative Jurisdiction within two months.

The announcement is signed by the Councilor for the Area of Planning, Urban Development and Housing, Roads and Works, Lighting and Mobility, Mauricio Aurelio Roque González (Decree No. 26777/2023, of June 26). The modification ensures that the planning of the Vegueta-Triana historical complex complies with court rulings, providing legal certainty to property owners and urban operators in the neighborhood.
