Vallehermoso recurre el plan general de Vitoria ante el TSJPV

The Official Gazette of the Historical Territory of Álava (BOTHA) number 103, dated September 9, 2026, publishes the summons to interested parties in the contentious-administrative appeal, ordinary procedure 315/2026, heard before section 2 of the Contentious-Administrative Chamber of the High Court of Justice of the Basque Country (TSJPV). The appeal has been filed by Vallehermoso División Promoción SA against the agreement of the Vitoria-Gasteiz City Council dated December 22, 2025, by which the new general urban development plan of the Alavese capital was definitively approved.

The publication, with official reference 2026-02539, is carried out in accordance with article 49.1 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, and aims to notify the procedure to those who may have a legitimate interest in it.

A dispute that conditions urban development

The general urban development plan is the instrument that establishes the city model and land-use rules for Vitoria-Gasteiz; therefore, its definitive approval, adopted by the council in December 2025, affects numerous agents: owners, developers, neighbors, and entities with interests in the municipal territory. The challenge by Vallehermoso División Promoción SA, a company in the real estate sector, opens a dispute whose resolution may condition the execution of certain planning determinations.

The summons is addressed to all persons and entities who, if it suits their interests, wish to appear in the procedure as a party. The deadline to do so is nine days from the date of publication.

Deadline and appearance procedure

The document, signed in Vitoria-Gasteiz on August 31, 2026, by the Director General of Urbanism, Mikel Inchaube Ocerinjauregui, of the Department of City Model, Urbanism, Housing, Cleaning and Environment, summons interested parties under the following terms:

  • Appear in the contentious-administrative appeal 315/2026 before section 2 of the Contentious-Administrative Chamber of the TSJPV.
  • Submit the appearance within a period of nine days from the publication of the announcement.
  • Prove, if applicable, the status of interested party in the challenged agreement.
