Appeals and effects of collection

Against the agreement, which concludes the administrative process, a motion for reconsideration may be filed prior to contentious-administrative proceedings before the same body that issued it, within one month from the day following its notification or publication. This is established by article 14.2 of Royal Legislative Decree 2/2004, of March 5, which approves the revised text of the Law Regulating Local Treasuries, in relation to article 108 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime.

In the event of an express or presumed dismissal of the motion for reconsideration, a contentious-administrative appeal may be filed:

• Two months from the day following the notification of the express dismissal resolution.
• Six months from the day following the date on which the appeal must be understood as presumed dismissed.
• Competent body: the Contentious-Administrative Section of the Court of First Instance of León, in accordance with articles 8.1, 25.1, and 46.1 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.

The filing of the appeal will not halt the debt collection procedure, unless suspension is requested and granted.
