Utrera corrige su ordenanza de obras y abre 30 días de alegaciones

The Utrera City Council approved on October 2, 2026, in an ordinary session of the Plenary, the corrected text of the Municipal Ordinance Regulating administrative enabling titles for the execution of works and activities in the municipality of Utrera. The agreement is published in the Official Gazette of the Province of Seville number 195, of Wednesday, October 7, 2026, in the Local Administration section (official reference BOP-SE-2026-195018), and opens a period of thirty business days to submit claims or suggestions.

The correction is limited to the articles that were subject to amendment, such that the rest of the text no longer admits allegations in this procedure. The announcement is signed by the Secretary General, Juan Borrego López, dated October 5, 2026, and is processed under file number 710226000001, within Urban Planning Area 7 and the General Urban Planning Services Office (DIR-3 LA0001346).

Thirty business days for allegations

The period is counted from the day following the insertion of the announcement in the Official Gazette of the Province of Seville, and during that period, any interested party may examine the text and present the allegations, claims, or suggestions they deem appropriate. The legal authorization invoked are articles 49 and 70.2 of Law 7/1985, of April 2, Regulating the Bases of Local Regime, and article 56 of the Recast Text of the Local Regime.

The agreement orders a new publication of the corrected text in three formats:

  • The Official Gazette of the Province of Seville.
  • The Transparency Portal of the Utrera City Council.
  • The website of the Utrera City Council.

The articles subject to correction

The correction affects a broad block of the ordinance, from the first articles to the end of the articles. Among the revised precepts are:

  • Articles 5.1 a, 11.4, 16, 24, 28, 30, 32.8 and 40.
  • Articles 51.3 n), 53.1, 58, 63, 64 and 65 and 65.
  • Articles 68.2 c) and d) and k) and l), 82 and 83, 90.4 and 90.6.
  • Articles 93.2 sections c) and d), 100 and 101 and 103 sections 3 and 4.
  • Articles 105 and 106, 116, 118 and 118 sections c), d), f) and g).
  • Articles 120 d) and 2, 121 sections 1 and 2, 124, 127 d) and 2 and 128.1 d).
  • Articles 132.1 sections g), h), j), k), l), m), s) and t) and 135 sections 3 and 4.

Background and effects of the procedure

The regulation stems from the initial approval agreed upon by the Plenary in the ordinary session of September 4, 2026, published in the Official Gazette of the Province of Seville number 181, Thursday, September 17, 2026 (reference BOP-SE-2026-181019). That announcement submitted the complete ordinance for public review along with its Annexes I to V and the application forms; now, the City Council is again displaying only the corrected articles.

The outcome of this process conditions the entry into force of the regulation. If no claims or suggestions are submitted during the public information period, the ordinance may be understood as definitively approved. If they are submitted, they must be resolved by the Plenary, which must also express itself explicitly regarding the definitive approval.

The ordinance regulates the administrative enabling titles for executing works and carrying out activities within the municipal district—that is, the framework in which urban planning licenses and authorizations are fitted. The correction directly affects developers, companies, and residents processing construction or activity permits in Utrera, who have thirty business days from the publication to review the modified articles and make any allegations they deem appropriate before the text is finalized.
