Utrera authorizes an 80 kWp photovoltaic plant for irrigation on rural land
Por FactBox Admin

The Utrera City Council has definitively approved the action project to implement a photovoltaic plant of 80 kWn (93.60 kWp) intended for pumping self-consumption with surplus compensation on preserved rural land. The agreement was adopted by the municipal Plenary in an ordinary session on October 29, 2026, and is published in the Official Gazette of the Province of Seville (BOP) No. 215, of November 6, 2026, with reference BOP-SE-2026-215041. The promoter is the Los Melones Irrigation Community.
Plenary Approval and File
The announcement, issued by the Urban Planning Area of the Utrera Council and signed by the general secretary, Juan Borrego López, on November 4, reports the definitive approval of the Action Project with file number 006725000005 and outgoing registry number 2026/33987.
The project is processed as a prior authorization for extraordinary activity on preserved rural land, a status that allows singular uses on land not classified as developable. The installation is located in polygon 64, plot 17 of the municipality of Utrera, in the province of Seville.
Technical Characteristics of the Installation
According to the approved document, the plant has the following characteristics:
- Nominal power of 80 kWn and peak power of 93.60 kWp.
- Purpose: electrical self-consumption for the irrigation community’s pumping system, with surplus compensation to the grid.
- Location: preserved rural land of polygon 64, plot 17, in Utrera.
- Urban qualification term: 25 years.
The project was drafted by industrial engineer María del Pilar del Forcallo López without the mandatory professional college visa, accompanied by the corresponding responsible declaration for the submission of non-visaed technical documentation. The file entered the municipal registry on November 26, 2025, under number 2025/48939.
Deadlines for Appeal
The resolution ends the administrative route, therefore the announcement details the available means of challenge:
- Optional appeal for reversal before the Mayor of Utrera, within one month from the day following the receipt of the notification, in accordance with articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.
- Contentious-administrative appeal before the Contentious-Administrative Court of Seville, within two months, according to article 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
- If the appeal for reversal is chosen, the contentious-administrative appeal cannot be filed until the former is expressly resolved or dismissed by silence.
The authorization comes after the City Council completed the processing of the urban planning file, which includes the technical documentation and the developer’s responsible declaration. The announcement is published for general knowledge through the provincial body.
The approval of this installation reflects the way in which the irrigation of the Bajo Guadalquivir meets its energy demand: water pumping is one of the most electricity-intensive consumptions in the agricultural sector, and self-consumption photovoltaics allow irrigation communities to stabilize their bills and reduce dependence on the grid. The decision, however, consolidates an industrial use on rural land preserved for a quarter of a century, a sensitive point in a municipality with strong pressure on the territory from larger-scale renewable projects.
