Public utility for the Arco I photovoltaic plant, in Malpartida de Cáceres.

The Regional Government of Extremadura has specifically declared the photovoltaic installation CSF Arco I, located in the municipality of Malpartida de Cáceres, and its associated electrical energy evacuation infrastructure to be of public utility, which enables the compulsory expropriation of the affected properties. The decision is adopted by resolution of 3 August 2026 of the Directorate General for Industry, Energy and Mines and is published in the Official Gazette of the Province of Cáceres No. 155, of 14 August 2026, with CVE BOP-2026-3878.

File GE-M/03/22 was processed at the request of Gandasolar 16, S.L. (Tax ID B42772665), which requested the declaration on 16 May 2025 by means of a written submission from Ms. Loreto Domínguez Bayón and completed the documentation on 31 July 2026. The plant already had prior administrative authorization and construction authorization, granted on 5 December 2023 and published in DOE No. 244, of 22 December 2023, as amended by resolution of 11 March 2026 (DOE No. 60, of 27 March 2026).

The resolution, signed by the Director General Raquel Pastor López, is based on Law 24/2013, of 26 December, on the Electricity Sector, and on Royal Decree 1955/2000, of 1 December, which confer on these installations the status of public utility for the purposes of compulsory expropriation and easement of passage.

A 45 MW plant with its own evacuation line

The CSF Arco I installation will occupy 18 plots in polygon 1 of Malpartida de Cáceres, and its main characteristics are:

• Installed capacity of 45,120 kW, with a control system (PPC) that limits the power injected into the grid to 42,500 kW.
• 76,388 bifacial photovoltaic panels of 625 Wp (47,742.5 kWp) on single-axis trackers and 141 inverters of 320 kW.
• 7 transformer centers 30/0.8 kV (52,096 kVA) and substation SET Arco I of 50 MVA (30/45 kV), in polygon 1, plot 9.
• Evacuation line of 45 kV of 19,533.73 meters, in 12 sections, to the Cáceres substation of I-DE Redes Eléctricas Inteligentes, S.A.U., affecting Malpartida de Cáceres, Casar de Cáceres and Cáceres.
• Material execution budget of €28,834,344.93.

Expropriation: plot 38 and the owners in the surrounding area

The declaration inherently implies the need to occupy the affected property and rights and entails the urgent occupation, in accordance with Article 52 of the Compulsory Expropriation Law of 16 December 1954. The annex to the resolution details the list of properties required to be expropriated in the overhead and underground sections of the line.

Among them is plot 38 of polygon 25 in Cáceres (cadastral reference 10900A025000380000MJ), used for pasture, whose holder, Antonio Melchor Olgado Martín Javato, filed objections and proved his status as owner; the remaining co-holders did not submit documents during the hearing procedure, and he reaffirmed his own.

The following also filed objections during the public information period:

• Antonio Hisado Arroyo.
• María Magdalena Martín-Javato Martín-Javato, María Guadalupe Martín-Javato Martín-Javato and Antonio Fernández Barquero.
• Dorinda Aventín Hughet, acting on behalf of Nuria María González-Sandoval Casares, Julio González-Sandoval Casares and Pablo González-Sandoval Casares.

The annex also includes other affected holders, such as the heirs of María Paloma Vázquez González Sandoval, the siblings Olgado Martín Javato, Inés Manzano Rubio, and the companies Famingel, S.L. and Mosacata, S.L.

Processing and appeals

The administrations, bodies and public-service companies consulted through separate reports did not express opposition, and the promoter accepted the reports issued. This resolution, which does not put an end to the administrative procedure, may be appealed by way of an appeal before the Department of Industry, Energy, Science and Territory within one month of its notification, in accordance with articles 121 and 122 of Law 39/2015, of 1 October.

Jurisdiction corresponds to the Directorate General of Industry, Energy and Mines under the Statute of Autonomy of Extremadura and Decrees 11/2026, 18/2026 and 107/2026, which establish the organisational structure of the department.

With this declaration, Arco I passes the last major administrative step prior to its construction and becomes a milestone in the provincial photovoltaic deployment. The authorisation to expropriate directly affects the owners of estates in Malpartida de Cáceres, Casar de Cáceres and Cáceres, who have one month to appeal the resolution.
