The Official Gazette of Castilla y León publishes this Thursday, October 15, 2026, the ruling of judgment no. 207/2026, dated May 26, from the Court of First Instance, Social Section, Plaza no. 1 of Ponferrada, which upholds the claim of María del Carmen Amigo Santiago and nullifies the assignment of position RPT 97350 from the open and permanent transfer competition. The publication is carried out through the Resolution of October 9, 2026, of the General Directorate of the Civil Service, of the Ministry of the Presidency, in issue number 200 of the gazette, page 10 (reference BOCYL-D-15102026-200-1). The same authority publishes, on page 11, the resolution of the Vice-Ministry of Public Administrations, Institutional Relations, and Citizen Services that complies with the ruling (BOCYL-D-15102026-200-2).
The ruling and its effects
The judgment, issued in ordinary procedure no. 439/2025, upholds the claim for recognition of rights and payment filed by the worker against the Regional Government of Castilla y León. The court nullifies the assignment of position RPT 97350 carried out in the open and permanent transfer competition of May 20, 2025, published in the B.O.C. y L. of May 26, 2025.
The operative part condemns the defendant administration to:
- Award María del Carmen Amigo Santiago a full-time service personnel position in the Bierzo area.
- Pay her 1,845.38 euros, of which 1,617.38 euros correspond to salary and 228.00 euros to the proportional part of extra payments.
- Add to that amount 10% default interest, as wages for the month of August 2025.
The publication is agreed upon in accordance with Article 118 of the Constitution and Article 17.2 of the Organic Law of the Judiciary, for general knowledge and compliance. The document is signed by the Director General of the Civil Service, Francisco Javier Raedo Aparicio.
Execution: transfer commission and payment
The Vice-Ministry of Public Administrations, Institutional Relations, and Citizen Services issued the compliance resolution on October 5, 2026, now published by the General Directorate of the Civil Service. Its operative part orders:
- Order the compliance with the ruling of judgment no. 207/2026.
- Nullify the award of job position no. 97350 to María del Carmen Amigo Santiago.
- Establish the Transfer Commission so that, within the framework of the Resolution of May 20, 2025, it may make the proposal for the award of a vacant position in the professional category of Service Personnel (Group IV), full-time, in the Bierzo (León) area.
- Pay the recognized amount, plus late payment interest, charged to the Department of Education, the body in which the interested party provided services.
The resolution recalls that an incident regarding the execution of judgments, as provided for in Article 238 of Law 36/2011, of October 10, regulating social jurisdiction, may be promoted against its provisions.
Procedural Framework
The origin of the litigation is the open and permanent transfer competition for the filling of job positions assigned to labor personnel in the service of the General Administration of the Community of Castilla y León and its autonomous bodies, convened by the Vice-Department of Public Administrations and Citizen Services. The position in dispute, identified by its job relationship code 97350, was linked to the health and care area of Bierzo, in the province of León.
The ruling is not limited to annulling the award: it obliges the administration to redo the destination proposal through the competent collegiate body and to provide financial restitution for the period during which the plaintiff did not receive her remuneration. The judgment thus has a direct effect on the organization of service personnel in the region and on the criteria applied in the mobility process.
Impact for Affected Personnel
The resolution published today confirms that the annulment of position 97350 is final for administrative purposes and that the Regional Government of Castilla y León must execute it without room for discretion regarding the merits. For the staff of the Bierzo area, the precedent reinforces the requirement that awards from the transfer competition respect the worker’s right to a full-time position and full remuneration for the claimed period. Any person interested in the procedure may consult the full text of the ruling and the compliance resolution in issue number 200 of the bulletin, corresponding to October 15, 2026.
