Traffic Department assumes sanctions for urban road violations in Nigüelas

The Provincial Traffic Headquarters of Granada will assume the sanctioning authority for traffic regulation violations committed on the urban roads of the municipality of Nigüelas. The agreement, signed on September 14, 2026, by the provincial head of Traffic, Juan Diego Ramírez Llorente, is published in the Official Gazette of the Province of Granada number 182, corresponding to Monday, September 21, 2026, with the official reference BOP-GRA-2026-182001. The measure comes into force the day after its publication and will remain in effect until the Nigüelas City Council expressly resumes the authority or the circumstances that motivated it disappear.

A municipal request due to lack of resources

The proceedings began with a request from the council itself. On September 9, 2026, the Nigüelas City Council forwarded the plenary agreement of July 27, 2026, in which it proposed the assumption of the sanctioning authority, citing the insufficiency of municipal services to ensure its proper exercise.

The Provincial Traffic Headquarters requested a report from its Sanctions Unit, which found no objection to processing the files that might be initiated. The document considers the justified reasons and the exceptional nature of the request to be proven, in line with what was stated by the plenary of the municipal corporation.

What Traffic assumes and what remains municipal

The agreement is based on Article 84.4, third paragraph, of the consolidated text of the Law on Traffic, Motor Vehicle Circulation and Road Safety, approved by Royal Legislative Decree 6/2015, of October 30, which allows provincial heads to assume the authority of mayors when it cannot be exercised by them. The distribution of tasks is as follows:

• Traffic assumes the sanctioning for violations of circulation rules on urban roads in Nigüelas.
• Traffic also assumes the instruction of the sanctioning proceedings, as this always corresponds to the administration that resolves them.
• The Nigüelas City Council maintains the organization and control of traffic on its urban roads.
• The City Council retains the surveillance and reporting of violations committed on said roads.

The text also invokes Article 25.2, section g), of Law 7/1985, regulating the Bases of the Local Regime, which attributes to municipalities the authority over traffic, vehicle parking, and mobility, and Article 7 of the traffic law, which defines it as an inherent competence.

Without economic compensation and with official publicity

The agreement specifies that the instruction shall be carried out without financial compensation from the General Directorate of Traffic to the Nigüelas City Council. The publication of the agreement is ordered through the Official Provincial Gazette, in accordance with Article 45 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

The document is framed within the State Administration, under the Ministry of the Interior section, and occupies pages 4 and 5 of the gazette, which consists of 70 pages. The file is identified by number 2026047504.

The change directly affects the drivers of the municipality: reports of infractions committed within the urban center of Nigüelas will no longer be resolved by the City Council and will instead be processed by the Provincial Traffic Headquarters of Granada, which will be the body to issue the sanctioning resolutions. This is an exception to the usual distribution of competencies, provided for cases of lack of municipal resources, and is reversible if the council recovers the capacity to exercise it.
